Timeline

Whilst filling out packet 3, i came across questions relating to criminal history.

Is receiving a police caution regarded as criminal history?

for example if a subject was arrested for a minor crime and simply cautioned would this have to be mentioned on the forms or would one still be required to answer as YES?

The caution in question as stated is a minor one and is not classed as moral turpitude etc...

Any takers for the answer??

I think its best you disclose it:

"Under United States visa law, people who have been arrested at anytime are required to declare the arrest when applying for a visa. If the arrest resulted in a conviction, the individual may be permanently ineligible to receive a visa. In order to travel, a waiver of the permanent ineligibility is required. The Rehabilitation of Offenders Act does not apply to United States visa law. Therefore, even travelers with a spent conviction are required to declare the arrest and/or conviction."

It wont be a big deal but they may ask u about it during interview, but i think full disclosure is always best.

Yes, disclose it. The wording is somewhat nebulous for the K-1 application but when you get to the AOS stage there is no question about whether or not to disclose it because of the way the question is worded on that form so you would have to disclose it then. You don't want a situation where it wasn't disclosed at one level and then later disclosed at another just in case that comes back to haunt you. Write up a statement about what happened, include any documentary evidence and send it in. It is highly unlikely that a caution would result in any negative impact on your immigration file if it wasn't an activity involving drugs or 'moral turpitude'.
