When does 130 approval expire?

Okay everyone. Just a quick update.

My wife and I have finally entered the U.S. My wife was admited quickly and hassle free through the Chicago POE.

With her K3 visa and passport in hand, the admitting officer simply stamped the I 94 valid for one year.

Our situation is quite different since we both are working oversea and does not want to adjust status yet. We also want to wait close to the 2 year anniversary to proceeed with the 130 so that she can receive a 10 year Green Card. Currently our 130 is being processed at NVC. We have not done much with it since approval about a year ago.

DOES ANYONE KNOW IF THE 130 APPROVAL EXPIRE? WHEN?

Our objective is to have NVC process the 130 close to the 2 year mark and move forward with the IR VISA at that time. In the meantime we will continue to take advantage of the k3 multiple entry benefit.

Since my wife's entry into the U.S. this week, we wanted to know if the social security office would issue her a number. It turns out that they won't without a work authorization. HOWEVER, we were able to get her a state ID and driving permit simply by providing her passport with I 94 stamped and a copy of her birth certificate. THAT WAS ALL WE HAD TO PROVIDE.

All this took place in just a few short days after her entry.

Now if someone here could help answer my question about the validity of the approved 130. When does it expire? How long before NVC invalidate it or can I have them hold for another year for future processing?

Your wife is here already , So she will receive CR-1 GC & SS card within 2 months .

I-130 no longer relevant to ur wife obataining IR Visa.

Im confused why upon arrival on a K3 visa they only stamped her passport/visa for only 1 yr?? I entered as K3 and they gave me 2 yrs. And yes the ss office wont give ssn unless you have either the work permit card or green card. In our part we also waited until after our 2nd wedding anniversary to file for aos.

Just really confused with your wife's stamped visa for just 1 yr...

Approved I-130 expires in a year. Since your spouse already, here so you are done with the NVC. Now, deal with USCIS again and send “adjustment of status” package before your K-3 visa expire or apply for extension on K-3 visa by filing form I-539.

Yes, I am confused as well why they only stamped one year on my wife's 1 94. My wife plans to leave and re-enter between now and the next two years since we both work oversea. Am I correct to assume that they will restamp each time she enters the U.S.?

Does anyone know if there's a way for us to adjust status while working oversea? We work oversea and want to adjust status but do not want to wait for the interview in the U.S.? Is there a way to request an interview oversea or request exemption for the interview?

If this is not possible, we plan to proceed with the 130 visa and she will go through the interview and visa process oversea through the local consular.

OUR CASE IS DIFFERENT THAN MOST BECAUSE WE BOTH WORK OVERSEA. We want to adjust status in the states but we are unable to do the interview in the U.S.

If anyone has a better idea, please advise.

This is incorrect. My wife entered the U.S. on a K3 visa. She has to adjust status before a Greencard and Social Security can be issued.
