Why do people file both the CR1 & K3?

I am lost is there some secret that helps your paperwork get touched or approved faster when you file both CR1 & K3 paperwork for your spouse?

Do you have to send all the proff with the K3 documents that you sent with your I130? I know that there are no additonal fees but what about the evidence. Do they use the evidence that was submitted with the I130?

Correct me if I am wrong but the K3 visa you still have to file more documentaion when you come here to the states; where as the CR1 you are completed with your paperwork for a couple of years anyway.

If someone could please tell me why they file both that would be of great service to me. :whistle:

Hi,

In my case, we did not apply for CR1 rather K3 hoping to be with my husband soon, however our I-130 got approved in a month while my 129F (K3) is still pending with USCIS.

Our case is with NVC and we are still waiting for the Case Number and some were lucky enough to get it soon and some waited for weeks.

To answer your question.....yes we sent the same documents for I-130 and I-129F.....If you read carefully the wikiguide...you will get the entire picture of the process....it took me days to understand not fully though coz i still ask for guidance from our fellow VJ members who happen to have the same case as ours.

Hello,

Filing both the i130 and i129F is part of the process of obtaining a K3 visa. However you are truely petitioning for both an immigrant CR1 visa and a nonimmigrant K3 visa at the same time. In the past before the K3 process existed, people only filed the i130 which allows them to later apply for a CR1 immigrant visa. There used to be a shorter processing time for K1 visas than for CR1 visas. Since families should be able to be reunited in a shorter time frame congress came up with the K3 process.

In essence, if your i130 is not approved before your i129F is approved your spouse is able to join you in the US with a nonimmigrant K3 visa and later adjust status. However if your i130 is approved first you may either elect to apply for a K3 or apply for a CR1. During the times when there was a huge disparity in the processing times of non immigrant visas compared to immigrant visas a person may have decided to apply for the K3 visa if there was an urgent need to have the spouse in the US, since the nonimmigrant visas were being processed in a shorter time frame. These days however, both visa times are being processed at about the same rate give or take a few weeks or so. With that said now many people often will abandon their i129F if their i130 is approved first and then apply for a CR1 visa instead of a K3.

The reason they do this is because with the CR1 visa (the immigrant visa) your spouse is able to work right away and will not have to file additional paper work and pay additional related fees to adjust status. This saves time, money and frustration.

In I believe 2001 USCIS created the k3 [NON immigrant][Google Life act] so couples could be reunited sooner because I-130s [CRs and IRs] were taking a long time. Recently USCIS speeded up the immigrant spouse visa ]Cr/ IR] process and at this time it's a waste of time and money to do a K3.

Best to go with the immigrant visa [CR-1][i-130] without applying for the K3 [i-129F]NON IMMIGRANT until something should change. People that do apply for K3/K4 are not well informed at this time. Still works but cost more money and a LOT more hassel. Rare but could still be deported when adjusting status.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship
