Denied case....follow up!!!!!

Hey Guys:

Today I received the letter from USCIS, in the letter they said that was denied for failure to appear for biometrics. I do have areceipt stamped that proof that i showed up in 03/26/08 for my biometrics. Now they want me to file a motion to reopen my case paying $585.00 to do something I did already. Has anyone hear anything like this. I will make an appoinment to go to my local office this week to see what they say, but I do not think is fair we will have to pay extra $585.00 for do my biometrics again if was their mistake. The good news is that this may be fixable. Any advices will be appreciate them.

I think this might have been your second biometrics appointment. You said you went on 3/26/08 and your case is still pending. They may have sent you another notice because biometrics is only good for a year. Did you change your address in the past year?

No I have not change my address and in the letter they said they do not have any records of biometric been taken.

We went to our INFOPASS appoinment and we have some kind of good news they told us that they made a mistake and the officer (Really nice) called Vermont rigth away and talked to them about my case and how can be possible I got a denied letter since he goot the copy right there infront of his eyes. He scanned to them and they talked to each other for a little bit and then he just told me that they will fix the problem and I should not be worry about the letter, he asked me for my maiden mane and wrote something in the computer and told me since we werw coming from so far he will give me a 1 year stamp in my passport. So after all everything went smooth and we are gonna be able to sleep thoughtout the night (Thanks God) He even gave me his e-mail and told me to write him so he can give me an update in my case. Thanks guys for your support and I hope we get our approval soon.

Crazy stuff.......the USCIS does work in mysterious ways. I had to pay many hundreds of dollars to fix a mistake of theirs way back at the beginning of my journey. It happened at my interview for the K-1 visa. It was either ante up and pay a new application fee or fly back home, get it sorted out, and then fly back to the Consulate later for another interview, perhaps many months later. I did a quick cost benefit analysis and it was cheaper just to pay the fee and be done with it (not to mention the fact that I didn't want to wait any longer to be with my fiance). The Consul himself promised me I would get my original application fee back but I never did even after repeated tries. Eventually I simply gave up. I kind of got the feeling that even though they had no choice but to cop to the mistake, in some way they didn't want to acknowledge it with a paper trail.

Your case is very fixable which is the great news here. Moral of the story.....USCIS makes mistakes (apparently lots) so no one should accept a denial without a fight. You're already here in the US so between the Infopass appointment and getting your state representative or Senator involved, I feel confident you will be telling us about your approval very soon.

I got something just as bad, just found out I'm an indentity theft victim last night, some 4 credit card transactions added up around $506 and some cents that I didn't do/approve/authorize. Don't understand how people could charge my card without actually having to swipe the physical card itself. I have the card with me right in front of my eyes right now, the card is never lost/stolen. Someone told me they don't really need the card, they just need the numbers. Guess there is something new everyday. Already put claim, cancel the card, order new card, and everything, but I know this is going to be a long journey before it can be finally be done with/resolved.

And at the end even after my dispute they still charge to my account.

Direct TV is definitely something shady, I got charged $10 cancellation fee for cancel the protection plan, something I don't really need, but they said I signed two year contract (actually hubby did) so I have to pay when I cancel. But we have to use them and still using them because we have no other providers in where we live.

Thanks Kathryn41! I'm expecting to have a long run with the credit card company. Now I can't even access online because I cancelled the old card and I can't use the old card to go online anymore. I have to wait for the new card to come, then registered online again with the new card, supposedly in the mail. I have to call them everyday to check on those pending charges to see if it get dropped or it actually went through because I can't access online, perhaps I didn't catch it fast enough or put on the claim too late.

But looking at the positive side, I'm glad that it's a credit card but not a bank issued debit card.

Glad that things got fix and you should received your green card on time...just follow it up!!!

For the identity theft, run your credit report after all is sorted out.

For every single transaction that you do over the internet verify that you actually are agreeing in everything, those small "check boxes" can contain some pandora boxes!

was gonna switch to direct TV also but when we I found out that I need to sign a contract with them I changed my mind and get the Dishnetwork instead.I'm happy with it plus I got the Philippine channels too that I can watch and they have a promo 1 satellite receiver for 2 TV's so it's pretty a good deal.
