So ill make the first part of my story short and sweet as its the painful part. Im a Montrealer born and raised! After college eventually a got a job in sales that had me going to the states often, so often in fact that i asked my employer to get me a visa as i felt uncomfortable. They said they would but kept jerking me to the point where i had to quit. I took a job with another employer and my duties where the same (dealing with US clients). This time i got it in writing that they would get me a visa after 2 years of working with them ... He had issues with his partners and about 2 years in that company dissolved and I had to start all over again with that employer. However i became frustrated and decided to take things into my own hands. Got a US partner and we started our own business and i decided i was going to apply for an E2 visa. About a year in i felt it was a good time, the business was up and running, we had 3 employees already and it looked good on paper. I began to get everything together, however i kept holding off as i needed the $7k to pay the lawyer (when you start a business money is tight!!) Anyways, all this time i began spending almost all my time in NY going back to montreal less often as it became really easy once i began dating an amazing girl and spending all my time with her. Long story short ... we went on vaca together in europe, came back, immigration told me that i have been spending all my time here, took me in the back and gave me the 3rd degree. Took my statements, my prints and sent me back to MOntreal. They did however cut me a break (and he said he was cutting me a break) and did not ban me, just told me DONT COME BACK without a visa.

Sooo... i commence my journey, hire a lawyer (after talking with about 20) and am pretty much told that the E2 will not work anymore as i have an obvious intent to immigrate and the K1 is the best option. Me and my girlfriend (now fiancee) discuss and realize that it was only a matter of time and we both feel very comfortable and we get engaged and have been planning an amazing wedding ever since! Obviously not the way i wanted to propose, but i feel very blessed and am very excited to spend the rest of my life with her.

Now here is where i need the support ... Its been 7 months + and i still don't have my NOA2?!?!?? It's killing me and my lawyers only tell me that i have to be patient?!? Their instructions are right, and im being patient - i just dont understand whats going on and why MINE is taking so long while i see others take much less time on this website.

My fiancee has been amazing and we see each other every few weeks as she comes to visit and we go on vacation (anywhere but the usa), but she too is getting frustrated as our wedding plans remain in limbo and we are the only couple with like 3 wedding dates on hold! LOL!! Just need a break!

Welcome to Visa Journey. Work loads differ at the various processing centers. 7 months is at the long end of the scale, but still within reason. Did you check the USCIS website, and see what the processing times are for the center you sent your petition to? I know Vermont is slow. You still have a few months wait after you get your NOA #2, so don't set any plans just yet, or you will continue to be frustrated.

There are many reasons as to why your petition may be taking longer than others you've seen. One of your names may have gotten a hit in a database and they may need to do additional background checks. Processing times also vary by service centre, though they do shift petitions back and forth if one becomes extremely behind. There is no need to panic yet, but I understand how frustrating it is. I thought my petition wouldn't take as long, being that I'm Canadian, but that didn't seem to make a difference.

Hey there. Welcome to VJ and congrats on your engagement!

Well... I'm sorry you've had to wait so long for your NOA2. There are some things you can do now that you're outside processing times. Call up USCIS and tell them you're outside processing times. They may do a service request where they contact the Vermont Service Center to see what is taking so long. Another thing you can do is contact your congressperson and/or senators.

And while you wait there are some amazing people right here to wait with.

Welcome to VJ and I'm sorry that your NOAs are taking so long! I do have a question though. When you were coming into the US and spending the majority of your time here, what visa were you on? You say that the immigration officer told you not to come back unless you had a visa. You were on tourist visas before when you were coming in, right?

I'm not sure, but since you were denied entry, could it be that that is making your case take a bit longer? Since they (the government) knows that you want to immigrate to the US, I would imagine that they would want to have from you super substantial evidence to show that you and your fiancee are in a very genuine relationship and not doing it for the GC. This type of information will be asked for at the interview though, once you get there! I would suggest that the two of you start getting this information together now, while you wait, and start preparing your answers for the interview. Since you two seem to see each other a lot, it sounds like you will have lots of evidence, but the more the better in my opinion!

Hey YADFERBERG,

We have a similar story with entry denials. I will send you a PM later with our story, but needless to say, we are still waiting at 6.5 months for NOA2 from CSC. I am pretty confident the longer delay for us is the denied entry. I have several stats to show that people with denied entries take much longer to get the NOA2.

BTW, you were bullied by CBP (as were we)...they can't ban you unless you overstay a visit by more than 180 days, or use fraudulent documents to enter the US. The threat of banning you is just them power-tripping.

It is a shame though. I will be thinking about you,

It seems as if the longer wait could be a result of your previous incident with being warned. Nomatter which type of visa you go for the information is communicated, and you probably have been flagged. Still I'm sure everything will work out.
