Getting single mom to US under a K1 Visa from Phils

I just have some basic information so far, but here goes. And I hope I put it in the correct forum.

Single Filipina mom has infant girl. The natural father does nothing to support the baby, nor shows any interest in it. American man wants to bring mom and baby to US under K1 Visa and marry.

Baby does have the bio dad's name. Not knowing anymore info yet, Does the bio dad have to sign off on this deal, to permit baby to leave the Phils ?

What if he refuses to sign off? What if he just wont cooperate? What if he is "disappeared"?

If this meant mom going to US and dad not interested in caring for baby, it seems insane to just leave baby behind with no one to care for it, would baby fall into an orphanage just because stubborn bio dad wants to make things difficult? Mom loves her baby and of course would not just abandon it.

I would love to be step dad to the baby, but I get depressed thinking of all the red tape and games if bio dad plays a power trip and ultimately demands a ransom to sign agreement for baby to leave the Phils.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

The first two of these are the same, the last is an entirely difference situation. Why not say what the real deal is and we'll help based on that. Often, people do not just disappear, family usually knows where someone is even if they aren't in the RP. He can most like be found found so your situation will be the first two.

It is a case of her not going to the USA, not her baby going to an orphanage. Orphanage... chilling word to me.

You best get real patient if you are going to go on the Visa Journey, because it isn't easy. No matter this situation, there can be many bumps in the road ahead so you really have to decide if you can be 100% committed to the very end before going on this Journey. The normal time is about 7 months, however you have to be ready for obstacles which may delay the Journey. The first 4 and a 1/2 months are pretty easy, but after that, some things take place that can cause a delay so that last 2 and a 1/2 months are the most challenging to deal with (in my opinion).

That is a helpful link. It sounds like the mothers name is on the BC has much weight, and that the absent bio dad does not have much concern in immigration matters if the couple was never married. It sounds like mom can just take the kid to any country she wants, if he is under 7 years old. Im wondering if others have had similar experiences or knowledge of this.

Search the forums on "biological" and read, read, read.... plenty of feedback already here, you just need to search for it.

The search "bilogical" here brings up a lot of off topic items not related to my question, but thanks for the effort.

Wow, this is the clear, factual info I was seeking. Itz clear then, that for "illegitimate" children, no affidavit is needed from the father for the child to travel out of the phils, if child is traveling with mother. DSWD TY very much!
