I agree with your post melissa/martin. There are things that these couple didn't tell to each other. It takes time to know the person well not just an online conversation. It might be he never really knew her that much before filing a petition.

Unfortunately, Bill, you are still blaming USEM when you should be blaming yourself.

So Bill, can you explain those deduction and the gross income to us? If an employer pays someone 50,000 and when filing he has 12,000 in deductions, he still made 50,000 Bill. All deductions do is lower your taxable income Bill.

First I do not receive a w-2 I am self employed. On my line 22 of my 1040 Total Income it was only $12,708 for that year. In a business you take your deductions off the top first before putting your income on your 1040 then you are entitled to take all your regular deductions like no. of dependents and so on. In thinking about it you are partially right I put $1 Mil. renovation into a commercial building I have that year and the deductions for depreciation would be on a 30 year basis and so the real reason for the low income should have been for the loss of rental income for the year as it was empty. But I still have a Retail and an Internet business that made plenty of money otherwise I would not have had money to go to the Philippines or pay my employees.

Yes I think that this is the root of the problem that there is not good oversight and that the investigator can pretty much do as he pleases and most of them are Filipinos that are promised US citizenship if they do a good job after some amount of years and this leads to over zealousness. He also lied to Mercy about a whole lot of things and it is just not right. If you were able to pull up the first document that I made reference to;

uhhhh the pre-screeners are usually Filipino the CO's are American.

your statement is not accurate.

If you had read the USCIS Council's letter on guidelines that I had posted it says that they must be interviewed in their own language for the fraud interview and Mercy's interviewer was a Filippino.

After reading this thread, I'm still confused as to why the petition was denied... was it something the pinay did wrong or something the yank did wrong?

If she was forced to sign a form to withdraw the petition, surely she was told the reason, right? What was the reason?

Actually I think they thought they were doing her a favor by letting her Withdraw her Application because they felt they had enough to show she was a prostitute and so the could have charged her with Fraud and she would have been bared for life. The problem is that the charge is completely baseless and made up by the investigator because he could not find anything else to deny her for and Mercy is not the only one they are doing this to!!!

This shows you are a first class sleaze, and I think she got off lucky. What kind of life would she have had with you anyways? Definitely not being treated as a wife, but as a possession.

Actually one of my Lawyers threatened to quit if I got married again I wonder what that makes him? I then explained that I still wanted to have a family and kids as I have not been blessed so far in life and I also do not believe in having kids without being married so he gave in.

A lawyer with a conscious, no doubt.

It sounds like you are just the type of employee the Embassy is looking for you can be the one that denies based on pre-nuptial agreements.

Most people here did not experience what you and your fiancee have gone through. I think the best thing that you could do right now is hire an immigration lawyer. And from there ask your lawyer if there is still an option to marry your fiancee in the Philippines. If that's possible, go to the Philippines, spend time and get to know her and her family and then marry her. Gather as much as evidences like joint bank accounts, money transfer receipts, insurance policies, snail mails, emails, pictures, etc. It seems its the only way that you could bring her here in the US.

I am still having a hard time believing this sorry. You have been here since JAN and I have been involved in viewing posts on VJ since 2005 and this is the first time I have ever seen anyone saying the things you are saying and then screaming that it's happening to others. Is your intent to scare K1 filers? Filipina's or what? So far it's just your word and it's all heresay and conjecture.

Site some other cases for us to view and let us judge from that, until then I am considering this a troll post.

I have been thinking a lot about things since this has happened. We plan to marry this fall between semesters at her college. If the US Embassy lets us see; http://manila.usembassy.gov/wwwha009.html#Process

It is not clear that the US Embassy will give us permission to get married. They say say it will not be granted in the cases of suspected immigration fraud. I cannot believe they would deny me but I never thought I would be in the position that I am in now to start with. Another way they screw with you is that you cannot write to them. You have to show up in person and request permission and then what do you do if they deny you after you have made all the wedding plans. When it comes down to it the Catholic Church does not go by U S law and I am sure the US Govt. cant stop us from having kids.

I think that within the 5 years my Lawyer say it will probably take to fight this thing I can lay off my employees and move my Internet company to the Philippines. It costs a lot less for employees there. Besides the Internet works just fine there. I was able to pull up Youtube videos in her Nipa Hut out in the middle of nowhere in her barangay just fine on my cell phone.
