I am starting to assemble the AOS package (it looks like a nightmare :o at the moment )..and I wonder if , for the I-864 I can re-use the forms we used when we submitted the Affidavit of support for the K1 (i.e the employer letter from both sponsor and co-sponsor, from April 2006). We will submit the AOS EAD AP in July..Also, what if my fiance only has last year's tax return form and has been a student for the years before that. Is it sufficient if his income is greater than the poverty line now?

Thank you!

Re: taxes for affidavit of support -- rules have changed and now only one year of tax returns is required, so you should be fine.

Re: letters of employment -- would be ideal to use something more recent, although 3 months ago is not that bad. If using letters from April you may also want to include some recent pay stubs. You may not need a co-sponsor if your spouse is earning the required amount of money now.
