I am a UK citizen living in the US on a J1 visa which runs out this June.

My US boyfrind and I are getting married next month in the US. Am I correct that the following is the process:

1.Get married

2. He files I-130 & I-1864

3. I file I-485 & I-765.

Am confused as to what a K3 is - do I need to file that?

Will we definitly be called to interview - when does this normally take place and will it be in California where we live?

How long will I have to wait from filing the I-765 until I can work in the US?

Thank you!

You won't be filing the for a K-3 visa. I-130 and Adjust Status.

Read through the Guides here on VJ and the instruction pages for the specified forms. That will help to familiarize both you and your fiance with the process.

K-3 is a spousal visa - intended for married foreign national (married to US citizen) wanting to come to the US to live (essentially).

Do you intend to return to the UK after you marry (and wait for the K-3)? or remain in the US?

Thanks for your help - we will stay in the US. So as I am already in the US - I do not need to apply for a K3 is that right?

Correct - since (mainly) a visa is intended for travel TO the US (not much use if you're already here and plan to remain here).

There is a Guide for folks in your position - http://www.visajourney.com/forums/index.ph...page=i130guide2 - it gives you the information you'll need.

Follow the guide for adjusting status when both partners reside in the USA. Actually, he files an I-130 but the I-864 is "provided" as part of your I-485 filing. It can all go in the same envelope but treat it as if separate filings as they will not be kept together. Make separate checks for the payments.

Check and make sure your J1 has no requirement for returning to your country. If it does, it will say so on the visa itself.

The endorsement is usually on the IAP-66, and not on the visa itself.

That's not correct- it is found on both the DS-2019 (as it is now known) and the visa. The OP needs to check both as some people have had two different endorsements on the visa and the DS-2019.
