How Soon To Apply For N-400

Hi,

I just want to know how soon should I start applying for N-400? I was granted residence since August 30, 2006. Does this mean I can start applying after this date?

Also, I would like to ask if my travels out of the country affects my application. I travelled 3 times out of the country but only for 3 weeks each trip.

You can file within 90 days before Aug 30 2009, if you have been continuously married to a US citizen the entire 3 years, if not then within 90 days before Aug 30 2011.

ONLY trips lasting longer than 6 MONTHS will affect you.

That's correct for many circumstances, but note that the actual requirement is that you must have been continuously married to and living in valid marital union with a US Citizen for an entire three years before the filing date. That's generally (but not always) interpreted to mean living in the same household. The distinction can be important for cases like CR-1 applicants who were married but living separately until the date LPR status was granted. Also, all the other citizenship requirements must be met on the filing date.

See the box at the bottom of page 22 of the M-476.

if you are applying based on 3 years of continuous residence as a Permanent Resident married to a U.S. citizen, you can apply any time after you have been a Permanent Resident in continuous residence for 3 years minus 90 days. You may send your application before you have met the requirement for continuous residence only. Therefore, you must still have been married to and living with your U.S. citizen spouse for 3 years before you may file your application. You must also meet all the other eligibility requirements when you file your application with USCIS.
