What is the deal already? :angry:

It can mean two things. Either all K-3s are affected by IMBRA or the USCIS is still debating whether K-3s should be affected or not.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

I don't know whether to believe this, but when I called USCIS the other day, they told me that K3s with an approved I-130 were NOT affected. The rationale they gave me was that "I-130 is the more important of the applications, and you're already married with an approved petition." They said no RFE would be issued and our I-129F would continue processing.

Again, this could be another case of the "Mis-Information" line spewing out incorrect info, when in truth, they don't know the answer, but that's what I was told. Make of it what you will! :no:

The USCIS Customer Service Center is run by a contractor and the person answering the phone is most likely a rookie, you might get lucky and reach a tier 2 staffer who has been around awhile but not likely. If USCIS goes the way of other Customer Service Centers like Bellsouth we will soon be talking to someone in Pakistan or India...lol

Hmmmm. Laws are meant to be universal. To be fair, any and every petition for a fiancee or spouse should be filtered through IMBRA. There are many loopholes now and opportunities for liars to lie. Perhaps USCIS is realizing that it's not as simple as mailing RFEs to K1s.

Suppose a person married a USC who's a potential abuser. Shouldn't they also know their rights and the background of their spouse? This includes CR1s as well as K3s.

I did not want to start another thread so I am gonna ask this here what is the prior processing time for I129Fs. Has it always been 60-90 days? this is what the automated system said yesterday when I tried to check it.

I do not wish to share any information about this dead end journey.........I have reached my final destination on this train, and it is time for me to get off.

When I talked to USCIS last week, I was at 90 days. They told me to wait another 90 days to call again! I dunno what prior time was, but CR1 seems like heaven simply to not have to deal with them again for a while!

OKAY...

I've been on hold with USCIS... listening to the devil playing the bagpipes :devil: , for about 40 minutes or so (only 10 minutes over my normal call time, yay...) <_<

After asking about my I-129F AGAIN, she tells me all she can do is look our case up online, same dang thing I'm already doing! :huh:

Now they tell me instead of waiting 30 days after the 90 days is over to contact them again, they say there is nothing they can do about my case until it has been 6 months since I filed! :bonk:

However, she said I could write a letter of inquiry to this address for further info about our case...

Forgive me if this sounds stupid, and please if this is wrong correct me as this is just my thinking.

K-3 is not necessary to get spouse here, just quicker under normal situations.

I-130 is necessary

It seems to me, that since the I-130 is a way around the whole IMBRA thing, they would either skip people that are already married and using I-129f, or decide to include I-130 in IMBRA along with I-129f. Hope they don't do this.

People could still get married, and just use the I-130 for a CR1 right?

Maybe they'll just make a sepearte version of the I-129f for K-3. If the morons had did that to start with...we'd be ok.

Yes, trickyspark, one would think intelligent USCIS people would be discussing this issue as we speak. But they don't make the laws; they only carry them out. They're not asked to think things through, from every angle, and with all the ramifications. I believe they'll be quite literal, because that's their mandate: go after people who buy mail order brides through marriage brokers.

K3s got caught up in the mess because we use the same form as K1s. Why? Because USCIS never got around to making one for us. None of this makes any sense, which is why I'm inclined to believe it's the most likely explanation. It's the government, after all. Five dollars says K3s never get an RFE and neither do CR1s.
