I got married in January in the US, i left the country in Feb and have been here since waiting for paper work to clear and permission to go back and be with my wife.

In Jan straight after the wedding we filed for the I130, this has been approved and we then went on to file for the I129f, this too seems to have been approved now.

I received my packet 3, collected all my paper work and had my medical 2 weeks ago. As of yet i still havent heard from the embassy about my interview date - first question, any ideas how long i should wait or can i chase it up some way??

I am hoping once i have my K3 visa i will be able to go to America and be with my wife - at last!! Here is where i get a little confused. Should i be filing or AOS once in America, i thought this was the best route to go down but i have seen some timelines and it looks to take forever in order to get sorted.

Should i go with the I130 and come back with my wife to England for the interview?

I don't mind about the status of it all, all i want to do is have a life in America with my wife, i am really asking for an opinion which was is going to be quickest to get permission to work and travel outside of the US?

So many forms and so much time has got be frustrated and just wanting an end to it, can anyone give me advise which route will be best to live in America, work and be free to holiday with my wife??

If your I-130 has been approved your best bet would probably be to let that run along and get your green card through the UK embassy.

In the meantime, if you have an interview pending for your K3 visa (which is what I think you have said), you can get your K3 and be with your wife until the next interview comes along.

Several people have done this recently and had a very smooth ride through the process (UK embassy) I was going to go this route too as my I-130 was approved on the 28 Dec, just after my K3 interview but in the end chose to go the AOS route.

As for the wait for the interview, there's a thread in the Embassy folder for the UK embassy which should give you a fairly good idea of what to expect. I submitted my forms Oct and got an interview in Dec last year.

Permission to live, travely freely and work (immediately) in the US happens through Permanent Resident status.

A person who comes to the US on a K-3 must still become a Permanent Resident. There are 2 ways to accomplish this:

1- Stay in the US and apply to Adjust Status/AOS

2- Return to the home country when requested and attend an Immigrant Visa (CR/IR) interview.

When the K-3 interview and CR interview look like they will be close together, some people 'abandon' the K-3 interview and opt to wait for the better CR interview.

If the I-130 passes the I-129f and reaches the Consulate first, there is no choice; the beneficiary can only have an Immigrant Visa interivew.

How long *your* AOS will take is anyone's guess. You can look at the posted processing dates for your District Office to get an idea--it can be from 3 months to 3 years.

As for a holiday, a K-3 is a multiple entry visa that lets you travel. It does not however, let your work without an additional document (EAD) which can take 90+ days to get.
