Hello folks,

I received RFE about filling out I-864.can any one tell me how important it is that i am wokring and making such money for 2 of us.

further more on part 3 your totoal number is 1

and on part 5 .......

it says if you are married write 1 in the box....

if i write one 1 that makes us 3 ....and we are 2......

please tell me what is the minimum income do i need to qualify.

You need to be able to support your wife, and yourself 125% above the poverty line. You can find the poverty guidelines at USCIS.gov , its very important, you need to prove that she wont become a public charge on the U.S government, if need be, get a sponsor.

April 10, 2009-Biometrics appt. done, in and out in 15 minutes

Nov. 18, 2009-Card production ordered

Your income needs to be 125% of the poverty line, otherwise, you need to have a co-sponsor. Check the following link for the Poverty Line list:

You don't need to put 1 for the spouse since he/she is your dependent, so he/she was already added. It was stated in the form that you don't double-count the person.

Thel previous document posted of the guidelines is for 2008. The new 2009 guidelines have been posted, so you have to go by that now.

2009 Poverty Guidelines

For two people you must make $18,212 per year.

You need to re-do your form and show a total household of 2. Do not mark souse like AndyJona said above.

Send in latest copies of your income tax return including your W2s or 1099. A transcript from the IRS is free and can take the place of sending the return and W2s.. You may send in the two years before your latest if it helps your case of showing income.

Send in at least one of the following to further support your proof of income. These are a couple of suggestions, but not the only way you could show your income.

6 months of most recent pay stubs. (photocopies)

A letter from your employer stating your yearly salary, how long you've worked there, whether you work full time, and if it is a permanent position.

Copies of financial statements if you are going to list your assets (savings, investments)

You don't count the same person twice (if its just you and your wife the answer would be 2 ). The person filling out the form is allready counted as 1 , and listing your wife on question #1 makes your household size of two . And all the other questions you leave blank , unless you have childreen or someone else living in your household . USCIS will figure it out , by the other information you entered in the I-864 , that it's only for you and your wife . And you have no childreen at the time that you file the I-864 . "DON'T COUNT THE SAME PERSON TWICE anywhere on the I-864 AFFIDAVIT OF SUPPORT"

Please tell me my wife she did her taxes on 9000$ for 2007.now she is making 40,000$

If you made $40,000.00 in 2008 you meet the Federal Proverty Guidelines . $40,000.00*125%=$5,000.00+$17,500.00=$22,500.00 Your Adjusted income . And your Annual Income of $40,000.00 is greater than $22,500.00 Adjusted income . You meet the requirement , as long as you can legally prove you made that $40,000.00 in 2008 . Then you have nothing to worry about .
