Should I change my passport before the interview?

My passport will expire in April 2010 and we just mailed the K1 package. By the time I'll have my interview it'll probably be September / October, which leaves me with 7-8 months left on my travel document. Should I change it before the interview so I can get my K1 in a new passport? I don't think I'll have my AP / greencard fast enough and I don't want to travel with an expired passport. What do you guys think?

Welcome to VJ,

To get in and out of a country, you need a passport. Sometimes they have the requirement that you need 6 months left on your passport after you return from your trip. You can not travel on you K-1, GC, or AP. The AP and GC will allow you to return to the US after you leave. You have to have a passport.

You should check and see how long it takes to renew your passport and how far in advance they will let you renew it. You should be all right getting to the US on a K-1 visa, but if you need to travel after you get here, you will need AP or GC.

It may or may not be easy to renew your passport in the US. If you go back home to renew it, it may take months. Therefore, you may want to go ahead and renew your passport now if they will let you this far in advance.

There are many documents you need to get together for the interview at the Embassy. You should start now. Read the Guides above and start getting things together. You will need originals for the interview of a lot of things. If you don't have them, your fiancee will have to get them together and mail them to you.

Good luck on your journey.

With your likely timeline, it will not be an option.

Do it now if you can. My wife renewed hers, she had two years left on her old one, but now it will extend beyond the time she can become a citizen or at least until the first 10 year green card renewal.

Not true. Consulates will affix a fiance or spouse visa to a passport issued the day before the interview but they do generally want at least six months remaining validity to do so.

Yes, I'd get the passport renewed.

I will only add that for travel to Canada and Mexico and Carribean Islands a US permanent resident does not need to use theur passport. The GC is sufficient. We live at the US/Canada border and travel to Canada 1-2 times per week, sometimes more. My wife uses only her green card and never has a question. For other countries, you are exactly correct.

Yeah, I might want to travel back to Romania after my AOS, to see my family and I don't want to deal with an expired passport. I know about Canada and Mexico and I think it's great! But my Romanian passport is still important since it allows me to travel freely, without any visas to any country in the European Union.

When you fly, the passport is required. Your solution only works with ground transportation.
