It's so messed up!!!!

It's the second time when I go to a different DMV in New Orleans and they just don't know the regulations and they keep telling me that they can't issue me a driving licence,because I do not have 180 days in my I-94...this is so stupid.

It's very clear in louisiana laws that only non-immigrants need to have days left on I-94 or work authorization.

there is a classification for applicants for permanent residents,where it's expalined thatwe applied for change of status ..so we are called immigrants permanently residing in the USA..we are not yet permanent residents..so we do not have I-551 stamp....

there's also a note there that says:fiancee,once married with USC need to present:Notice of Action(I-797)+passport+marriage certificate!

It's so clear..we don't need to have work authorization or days left in I-94!!!

I do need driving licence.I was admitted to the master and I don not have how to go.I will also do not have how to go to work.accorrding to their explanation that I need to wait for green card!!!

Pleas somebody any sugestions?Any other dmv that u have experienced???Or did anybody try to get any official paper for their state to show to the local dmw?

Because I printed the web-site and showed to them and it didn't work!they said they have smth else in their computers and they can't show me what.I also called the state dep of public safety they send me to office of mtor vehicle and they told me I am right ,but I have to go back and talk to the supervisor...I did that and the supervisor was stbborn and she told me the same story with I-94!!!!!!!!!!!!!!

I go crazy!!!pls help

I called the DMV here and talked with the Head and he called the DL office and talked to someone there. He then told me to go to the DL office and ask for that person. It worked for us. You may try that. Call again to the supervisor that said you were right and have them call ahead for you and give you the person's name.

I read the page you gave, and I don't interpret it that you can get a license without an approved AOS. It's a little out of date since they don't give that temp stamp any more if your card is delayed a long time. Cards are processing faster now. I think EAD should allow you to get a license and that normally is received within 60-90 days.

I think the reason is some recent pressure on the states by the US federal government to quit giving a license with just a SSN like they used to. It's an attempt to cut down on illegals receiving documents where they appear to have legal presence in the US, like a driver's license. Texas just changed their laws Oct 1, 2008. An EAD card allowed my husband to get a TX license that expires the date his EAD expires. When he gets the green card, he can get that temporary status lifted.

Did you read Note 3 about fiance,once married?

Or the clasiffication for Immigrants permenantly residing in the USA?Our category of applicants is considered "immigrant..not non-immigrant..and only the non-immigrant are required to have days left on I-94 or work authorization...I 'm talking about LA,not other states.

I called the head and she told us we are right.

and it;s not anything out-of-date..

I don't know about other states...like TX.

I heard about this atempt.but LA didn't make any change yet.

Have you tried taking a printout of that page to the DMV? Maybe once you show it to them, they will be convinced.

You don't have to wait for the greencard. You should have your EAD card in 60-90 days from the date of biometrics. That will allow you to get a driver's license.

First of all, every state has got different rules & regulations related to issuing a DL.

I do understand your situation, it is frustrating !.....

but also I understand that you sent your AOS application on 01/20/09 & bio done 03/04/09.

So my suggestion is (at this point) : why don't you wait for your EAD to arrive ? You should be receiving it

sometime in April anyway. When you show your EAD, they have to give you a DL which is gonna be valid

until the same date your EAD expires.

I know it is diffucult path to be a PR, but the PATIENCE is the key.

I tried.They refused to read it!!

It's impossible...to talk to them.They just don't know their own regulation.I hav a DL from my country and in this case I don't need a learner's permit..I don't need to take driving classes again..but I couldn't make them understand that too...I am not talking from other's experinec.I talk only about their laws..and they are very clear.But workers from there have no idea what they are talking about..Believe me.

I will try again on Wednesday,because the head gave us a the phone number for the district manager and she said she will talk to the supervisor.

I hope it will work.

Otherwise I 'lll wait for the work permit.

Hello again!

Yeap..I did exactly like that:called the DL office..talk with the district manager..They all agreed with us.So we went back.Guess what...the supervisor from there was like...ah..you're not right..let me call them,..she did//she came back and she said yeah you're right...

so I presented all:passport,marriage certificate+NOA(exactly what they required me in my regulations)..they asked for my ssn card and I have it in my maiden name.They said they cannot issue DL, because the system gives errors until I change my SSN in my married name.###### up,man!!!

First..on their regulation they said I need one primary identification..which is passport and 2 secondary identification which are:SSN and DL from out-of-country in my case.It says the name on the primary idetif must match the name the secondary doc which they do...only the notice of action is on my married name.so,i don't know..it sounds just like another excuse for me.Because....anywhay in the note about fiance visa it;s not even mentioned that SSN is required!

...Now my ssn has a stamp which says":valid only with DHS authorization"which I figured it will not be there after I go at SSA with my work authorization.And I am thinking to go back at SSA when I have the work authorization and change the name and like I said the new card will not have that stamp on it.and will have my married name on it.

My question is..when I go back to DMV with my ssn in my new name they should accept it according to what they told me today....I am so upset///these people don't know sh....Excuse me,but they have no idea.First they told me that they need to call USCIS to check me for not having a fake receipt!!!!!!

They just lie and try to find reasons...for denying...and they were telling me that I need to have a learners permit!then when I talked to the head at phone she said I don't need,because I have a DL from Romania...which is exactly what I found in their regulations too/

I am thinking if I go back with the work authorization..the DL will be valid just one year?Then i have to change it?and to retake the vision test or the driving and written test too?and I am wondering...when I go back to renew it i need to have the green card.Right?They will not renew it otherway..I guess.
