aos stress

ok, getting all my stuff together for the aos, with the affidavit of support, do we HAVE to send in the past 3 years income tax statments or is the most recent one ok, we just dont have the past 3 years, so would 1 year and then the pay stubs for the past 6 months be ok.

Per instructions on the I-864:

"You must provide either an IRS transcript or a photocopy from your own records of your Federal individual income tax return for the most recent tax year. If you believe additional returns may help you to establish your ability to maintain sufficient income, you may submit transcripts or photocopies of your Federal individual income tax returns for the three most recent years."

By looking at the timeline in your signature, I was thinking huh? AOS? You still have your profile set on K-1 as well. I did click your timeline to see that you indeed DID enter on your K-1. Maybe change your profile from the K-1 status and eliminate the pink signature timeline.

The only thing they absolutely require, per the instructions, is a tax return (or transcript) from the most recent year. Sometimes, though, people will get RFEs for different things that will help them prove they have enough resources to qualify (usually the pay stubs, which you have already said you have). What we did was send a copy of the employer letter my boss wrote for me when we interviewed for the K1 (to show that this is a permanent position), 6 months of pay stubs, and my 2007 tax return. This was enough. If you have an employer letter, it will show them that your husband's job is a secure permanent position. I'd definitely send the copies of the paystubs since you already have them.

One other thing---in case you don't know this yet---if you send a copy of his return, you must also send copies of his W2, any schedules and 1099s that show the income reported. I realize you are young and may not have much of that, but he could have a 1099 from the bank just showing a small amount of interest on a savings account. If so, send a copy. If you order a tax transcript from the IRS (which is free, but I do not know how long it takes to receive), you do not have to send that.

thank you very much, i would think he does have all that, hes not quite as young as me :P we should be able to scrape all that up and we dont need a NEW letter from the employer they accepted the old one from the interview?

I agree that a new employer letter is probably better. In our case, though, we sent a copy of the one we used for the consulate and had no problems (my boss was on vacation and the one we gave the consulate was only three months old at the time---although it was addressed to the Vancouver Consulate K visa unit so it could not have been more obvious we were reusing it). If it is a huge hassle to get a new letter and the old one isn't terribly dated, you should be okay with it.
