US Citizen, filed AOS for Mom, Dad wants to come in for a short visit. Dad is working in the home country and has property there. Mom&Dad have the same last name and are married. Can Dad have any problem getting into the country at the point of entry? Does he need to bring any documentation (ie property title, employment letter) to prove that he is going back? thank you.

Honestly, depends on the country. Are they from a visa waiver program country?

Home country is Russia, ie not a visa waiver country

Theoretically there should be no real issues... but with the lack of information (such as home country) it's difficult to say for certain. :thumbs:

Then he'll need a tourist visa - strong ties to his home will be needed. Presumably you already know this and are asking if the fact that your mother has an I-130 pending will cause him any issues... it should not. :thumbs:

thank you. he has a valid B1/B2 visa. I am just concerned that at the point of entry they are going to check into their computer database and then discover that his wife has filed for an AOS and send him back.

Not likely (that they'd do a database match like that) but he should definitely bring evidence of strong ties to his home country (regardless of his wife/your mom having a pending I-130). :thumbs:
