Read careful , it`s very helpful. This link is created for a spouse but 99.9% the same for a parent.

One advice if you are applying for your mom and she is divorced when you send I-130 make sure you give them her divorce certificate. They requested this for as an extra document.

Umm, are you sure about the divorce document? The I-130 instructions say nothing about that, I thought that was evidence that was asked for later on by NVC after the I-130 petition had been approved.

I am absolutely sure. My mom is divorced I sent I-130 without divorce certificate . Why would I even think to send that. Well 4 months later they requiested the divorce certificate ans 10 days after that (3/19/09) I recived the NOA 2 Approved. I was shoked , never heard this before. Believe me my papers were just everything they wanted but they decided to ask for this certificate. I guess it`s up to the agent revewing the docs. It`s your decission.

From what I have heard from friends in different situatuions looks like USCIS wants to make sure that by approving a pettition they won`t break somebodys marriage. I have heard a lots of stories how they decline just to keep a family together. The moment I recieved this request I relised why they want it.

Believe or not their number one rule is to keep a family together.

hey guys, i am going to petition my mom only...my parents were separated since i was 7. none of them re-marry. they are not legally separated/divorced or none of them filed an annulment. they just live in separate houses, separated for 23 years already. my question:

1. is it okay just to petition mom? dad wont come to US.

2. is my mom's status still married even physically separated for 23 years? their separation has no legal documentation.

3. my mom's name on my birth certificate is misspelled. only the last letter of her name. instead of E its written as A. what you guys advise me to do? I have my baptismal, my school record her name on it. her ID's are all correct spelling. just my birth cert that was misspelled.

4. when i'm ready to submit my I-130 of course i will include my birth cert, should i just go ahead submit it even the last letter of my mom's name is misspelled? and i'll support it with my baptismal cert, my school record and her 2 proof of ID? any suggestions?

anybody here please help me what to do.

[hi ikyang I don't have a answer at your question but Im also planning to petition my parent, and I would like to know if you already petition them.coz mine is I also have problem with my birthcertificate, to tell you the detail my parent were never married but they are still together but the problem is they put on my birthcertificate that they were married and it has a date on it.so I don't know what will be the process for that if I just leave it as it it or I should go ahead and fix it.

let me know how it turn out to your parent and what you did.so I have an idea on what to do on mine.

any intelligent VJ member wants to answer my questions?

You rang..

1. is it okay just to petition mom? dad wont come to US.

Yes

2. is my mom's status still married even physically separated for 23 years? their separation has no legal documentation.

If not divorced then she is married.

3. my mom's name on my birth certificate is misspelled. only the last letter of her name. instead of E its written as A. what you guys advise me to do? I have my baptismal, my school record her name on it. her ID's are all correct spelling. just my birth cert that was misspelled.

I would go with it, if it becomes an issue deal with it at the time.

4. when i'm ready to submit my I-130 of course i will include my birth cert, should i just go ahead submit it even the last letter of my mom's name is misspelled? and i'll support it with my baptismal cert, my school record and her 2 proof of ID? any suggestions?\

Sounds good to me.
