Affidavit of Support, question on Sponsor status

Hello,

Does anyone know what to do in a case where a sponsor for a petition for alien relative (in this case, 1 parent) is going to be leaving their job this year to go to full time studies at university?

In short, the relative is my mum and I'm leaving my job in July to go to school full-time. I am still at the job I have held for the last 8 years (career-change) and will be until then.

- Which I-864 form do I fill out (the EZ, since I *currently* make well over 125% of the poverty level), or would I need to get a co-sponsor and file the I-864 regular form?

Sorry, for some reason it won't let me edit my original post:

I'm not sure if I'm supposed to tell USCIS that I'm going to leave for school in the middle of the year (in which case I'd have to get a co-sponsor). It seems logical that I would, but the forms give no room for that?

Also, how long does a parent petition take normally? (Since they are not constrained by visa queues)

Perhaps I was not being clear about what the issue is. It should be possible to do both, my question was not at all about whether or not I should go ahead with petitioning at all.

I could technically file the 864EZ because I am still employed at the same job that I would be providing W2's / tax forms for, but it does not feel honest to do so.

The alternative is to file the regular I864 form with co-sponsors (my husband on the I-864A or my uncle as a non-household member co-sponsor), but since I currently earn well over the salary cap, I'm concerned USCIS might ignore/question the need for co-sponsors. There does not appear to be room on the forms for any sort of explanation regarding my change in financial status.

Which method is the correct one to use?

From what you are saying/not saying, I assume you are going to be filing the Affidavit of Support before you quit your job. So at that point the affidavit is 'sufficient'.

So in theory - this will probably be good enough. Are they going to grill you about whether you are still in the same financial situation when it comes to the adjudication - maybe not.

What I would personally do - and again this is only my personal take - I would file the I-864ez now and if it comes to interview time and your financial situation has changed and you are now in school I would get that co-sponsor and the I-864 from them and take that to the interview (btw if you are using your Husband's income - he does not fill out an I-864A - his info would be included on your amended I-864 that you take to the interview - will all the supporting documentation, of course).

I don't think USCIS is really interested in what your financial situation will be like in however many months - they are asking for your current financial situation.

They are now, they will want it confrmed on adjustment, or a new one.
