DOES THE I-130 PETITION EXPIRE?

Hi everybody,

I would be completely lost without this website and the many helpful members!...Thanks everybody!

I have some questions regarding k-3 visas.

I filed for a k-3 visa and both the I-129f and I-130 petitions were approved in Jan 09.

I have decided to go with the IR-1/CR-1 visa, which I assume means I only need the I-130 petition.

Since I dont need the I-129f petition, is it okay to let it expire?

Does the I-130 have an expiration date?

Again I would like to thank everybody for their help and advice..

Hi Jens,

I don't know if it expires, but our I-130 and I-129F were being worked on at the same time. We decided to go with IR-1 instead of K3 because of costs and paperwork. We sent a letter to USCIS withdrawing I-129F because I-130 was approved. I called USCIS before and they said just a letter from the peitioner is fine.

Hi Jens!

Since you decided to pursue the I-130 petition (which is called the IR-1/CR-1 visa type), you will have to abandon your K3 visa petition

I am not familiar with the procedure of abandoning a K3 petition, perhaps you can call USCIS or write them a letter (as what corinne from oz said) and inform them about your intention to pursue the IR-1/CR-1.

As for the IR-1/CR-1, once your case has been forwarded to the NVC, they will keep your case "active" for a year, and if they do not hear from you (like you do not reply or comply to whatever they ask from you for a year), they will consider your case "abandoned".

My husband and I were able to drag our feet for about a year and a half at the NVC... I hope this information helps you.
