I need to make a visit to the United States before the winter.

Will I face any kind of barrier upon applying for a tourist visa especially given my prior experience with the K1?

i think this is all going to depend on if you had an overstay or not. from what i remember you did have one but it was less than 180 days.

i'm really unsure though. they my not issue you one because you've already shown that you had interest in immigrating to the US (via a K1) ... but then on the other hand, you've always shown that since the relationship didn't work out you left the US to return home.

another factor of consideration may be why you want to visit the US. of course this will be between you and the embassy ... but that may play a role. coming to visit a romantic interest, family, friends or having to appear in court to finalize your divorce: all these different scenarios may be looked upon differently when applying for a tourist visa!

An overstay of less than 180 days should not trigger a bar on admissibility. An overstay of 181 days would. If I remember correctly, you did not apply for AOS after entering the USA. Had you, it would always be prudent to withdrawn any abandoned petitions prior to application of a non-immigrant visa. (Sort of like doing a little housekeeping ;) )

I'm not going to dredge up your old threads---I'm sure we discussed this at the time and there was considerable confusion over whether or not you have a bar.

It's my understanding that even one day of overstay will disqualify you from using the VWP. Any day after Day 90 from the K-1 entry would be overstay *as I understand it*.

The recomendation at the time was for you to consult with a US immigration attorney with *your specific facts* and get proper advice. I'm not sure I would count on a Consular interpretation of what will be a CBP decision at the border.

A visa is merely permission to show up at the front door and ask to be let in, not a guarantee of entry.

you will need a tourist visa, and when you go to the consulate for the interview, bring as much evidence as possible to show your ties to there, this will help your case.

Oct 29th 2004 -Met online
Oct 29th -First phone call
Dec 25th -She purposed and i said Yes!
May 10th I-130 Packet and Packet 3 sent off to me by the U.S. Consulate
May 16th -Received Packets 1-3 from the U.S. consulate
June 29th -I arrived in Puerto-Rico!
July 2nd -Married in Mayaguez, Puerto-Rico and also got our interview date for September 6th
August 17th -We arrived in Australia to file for Sep. 6th
September 6th - Filed DCF in Sydney and approved 1 hour later!
September 12 -Received my passport with the visa and yellow packet
November 24th -POE.......Guam,USA
December 12, 2005-Green Card arrived in the mail
September 11, 2007 -Filed I-751 on conditions
September 17 -VSC Receives my I-751 and issues NOA1
Oct 10 -Had biometrics taken in San Juan, Puerto Rico ASC
Oct 12 -Touched.
Aug 21, 2008 -Approved!...........finally
Sep 17, 2008 -Mailed off N-400
Oct 22, 2008 -Biometrics taken in San Juan ASC
Feb 12, 2009 -N-400 Interview
Feb 26, 2009 -Oath.....the end.
