Timeline

Hello all! Im wondering if someone can help me with this. My husband is filing for his income tax. Can he claim me even if i dont have my ssn yet (we're filing for aos this month after he does his taxes). Can he put or use my A# instead? Is there a way this can happen?

March '05 - met George online thru common friend

March '06 - He went to visit me in the PI first time

May '06 - He came back for the family reunion and proposed for marriage

Nov. '06 - came back to prepare for our wedding

Dec 16, '06 - Wedding Day!

took at least 6 or 7 months (as i remember) for the K3 and was approved!

Nov '07 - I arrived in the US

together again with my gwapo, lol

April 9 - mailed in AOS package

April 13 - NOA for EAD and AOS

April 22 - Biometrics Appointment and will be on May 7 in Jamaica

May 7 - Biometrics done!

May 14 - Got an RFE dated may 9 - joint sponsor :-(

June 5 - they received our reply to the RFE

June 10 - EAD card production ordered, YAYYYYY Thank u, God!

June 21 - EAD card received in mail.

...and the waiting continues for the interview date...... will update later

so i got my interview date, and guess when??

Sept 10 - yaayyyy and its my hubby's Birthday! Approval would be a GREAT bday gift.

Sept 10 - got APPROVED! Indeed its a GREAT Birthday gift! " Card production Ordered" Yayyy

Sept 18 - Welcome Letter received!

Sept 19 - Green Card in hand!

You can file a W-7 from IRS and get a ITIN. Individual Tax Identification Number.

The for m is submitted with hubbys taxes. Can't E file tho. Must be sent in snail mail.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

you can not take any EIC.

Thanks guys, however one thing still i wanted to ask. The main reason for him claiming me is i guess to lessen in a way the money that has to go back to the government. You see, this year he made a lot more than last year.. it will end up him paying some money to the government. He wants to claim me this year so at least (maybe) he will not give more or any money back to the government. SO if he cant get any income tax credit from it, then would it be good to just file as "single" again and claim me next year when i have work already and have ssn??

In my own understanding maybe next year he can claim me and get something back from the governtment of all the years he filed as "single"? Btw, we were married 2006 and it would be 3 yrs now that he filed as "single". We were apprehensive then, until now that he cant claim me coz i dont work and dont have SSN.

Once you are married, he can claim you every year. There's no advantage to waiting for next year. He should have been filing married since his 2006 return (which is filed before Apr 15 2007). If he doesn't want to file with you then he should have been filing "Married Filing Separately" since 2006 return because he was no longer single at the end of 2006. In general a "Married Filing Joint" return normally results in less taxes than "Married Filing Single" return with the exact same income.

Just for your information. What you pay or get back as a refund depends on how much is taken out of your check. A simple example.

His taxable income is $35,000

If single his tax is $5,100

He had $5,000 taken out of his checks during the year

So he still owes $100 to the IRS

OR IF

He had $5,500 taken out of his checks

He had $400 too much taken out of his checks

He gets a refund of $400.

His tax is the same $5,100 but whether he owes or gets a refund depends on what got held out of his paychecks.

Now to show the difference of Married Filing Joint.

The same taxable income of $35,000

If married filing joint, the tax is $4551 which is less than a single person would pay ($5100)
