My husband is the US citizen petitioning for my green card. Does he have to fill out a G325A? In the guide it says he does, but I just wanted to make sure.

He is submitting a pettition for my 3 children also. Should we include copies and a picture with the G325a of him (the pettitioner) with each child's I-130?

I love being a Canadian.

The reason you have conflicting answers is that your question is not clear and there's no timeline or profile information to go by. When filing an I-130 for a spouse, the G325a and passport picture from the petitioner are required as well as the same from the beneficiary spouse. For a step-child this is what is required. (From the I-130 instructions)

8. Stepparent/Stepchild: If your petition is based on a stepparent-stepchild relationship, you must file your petition with a copy of the marriage certificate of the stepparent to the child's natural parent showing that the marriage occurred before the child's 18th birthday, copies of documents showing that any prior marriages were legally terminated and a copy of the stepchild's birth certificate.

Sorry, I just assumed that since I filed in the CR-1 forum people would be answering the question with that in mind. From the information you gave me, I can assume that the children do not need a G325A then?

Assume nothing. Study the information carefully and come to a conclusion.

yes to all your questions. you and your children both need to fill that paperwork out. hope that helps.

Timeline:

Sent in I-130 form: 01/29/09

Interview Date: 11/08/09 (APPROVED!)

Visa in Hand: 11/12/09

POE: 01/30/10 (!!!!) at JFK Airport in NYC... can't wait!

Got the green card maybe 8 weeks after 01/30/10...

TBC....
