Hello everybody.I've got a question and I hope somebody has a answer or at least could give me advise.

I'm planing to adjust my status.But. I have very good job.And probebly I'll lose it becouse of time line needed for processing.How can i get EAD before all process finished.And one more thing I'm working as DoD contractor.Could US government instalation overseas be considerate as terretory of US.

Complete your timeline first, nobody knows what are you talking about if you dont have a timeline, and what is your visa type?

EAD APPLICATION:

2009-01-10 ----- E-filed EAD Application

2009-01-20 ------NOA1 Receipt Notice

2009-01-22 ------Biometrics appointment recieved by mail

2009-02-11-------Biometrics Date (done smoothly)

2009-4-15 -------- EAD Approved

2009-4-24 -------- EAD Received by mail ( yyyeeeeessssss)

I'm not sure yet.I Don't know what is my timeline.But I know for sure adjusting status takes time.And You can't leave states untill process is finished.Or may be I could get some kind a axception.That way i don't have to stay in States all the time and wait.By the way visa type B1/B2.Timeline what I'm talking about iz maximum 21 days.Whats how long is my vocation

How can you have a job in USA and have B1/B2 status?

Dec 3, 2008 - Aug 20, 2009 (approval on August 7th)

Removing of Conditions

May 9, 2011 - October 4, 2011 (approval on September 28th)

Naturalization

July 19, 2014 - N400 packet sent out

July 21, 2014 - N400 packet delivered

July 23, 2014 - received email/text that I-797 is issued

July 26, 2014 - received I-797 in mail

August 11, 2014 - received the Biometrics notification

August 14, 2014 - biometrics walk-in (original date August 20)

August 18, 2014 - in line for interview scheduling

September 9, 2014 - yellow letter is received (letter is issued September 3)

November 3, 2014 - interview notice is issued (email/text alert)

November 10, 2014 - interview notice received with the interview date of December 11, 2014.

November 10, 2014 - request to reschedule mailed out

December 5, 2014 - interview notice is sent out (email/text alert)

December 11, 2014 - received an interview letter in mail

January 10, 2015 - interview on Saturday at 7am

January 26, 2015 - sent the requested documentation

February 26, 2015 - oath letter is issued (email/text alert)

March 2, 2015 - oath letter is received

March 18, 2015 - oath at 8am

I'm sorry .May be I'd explain everytning ,so no one could't understand what's going on.I'm not in US yet.I'm just about to come in.But at hte same time I do work for DoD.I'm the Army contractor.And just planing to adjust my status upon arrival to US.And i trying to find the ways to do it right, and to don't lose my job.

What Visa are you currently going to use to come to the US?

That has bearing if you can AOS. Some visas restrict what you are planning on doing.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Sounds like you have a B1/B2 and usually travel to the US with B1 for BUSINESS.

B1 is a non-immigrant visa.

If you come on vacation here, you will be under a tourist visa or the visa waiver program.

Anyway, it is a mute point, because none of these visas can be converted so you cannot stay here and adjust status without being illegal. You HAVE TO leave the country by the date written on your I-94 (the white paper you get when you enter the US).

What you need is a H-1 or better, a L-1 visa (intra-company transfer), though the latter would require you work for the same company here in the US as your company abroad. Seems you are not working for DoD but for a contractor.

You need to get your company to sponsor you for H-1 or L-1. And that's an entirely different story!

March 8, 2008: I-129F K1-Fiancee Visa Application mailed

October 27, 2008: K1 VISA RECEIVED !! (233 days - 7 MONTHS 19 DAYS)

January 17, 2009: Entry - POE: JFK w/EAD (315 days)

February 6, 2009: WEDDING! (335 days)

March 24, 2009: Sent AOS, EAD, AP package to Chicago Lock box (381 days - 1 YEAR 16 DAYS)

June 30, 2009: Interview in San Jose, CA (479 days) - NOT approved, Sworn statement required

AUGUST 14, 2009: GREEN CARD IN HAND (524 days - 1 YEAR 5 MONTHS 6 DAYS)

May 31, 2011: Sent I-751 Removal of Conditions package (1179 days - 3 YEARS 2 MONTHS 23 DAYS)

January 25, 2012: 10-Year Green Card Received (1418 days - 3 YEARS 10 MONTHS 17 DAYS)

You are arriving in US under a tourist visa but you are asking for a change of status? Do you plan to marry a USC? And I am confused... you said you dont want to lose your good paying job if you apply for AOS..... your issues confuse me ... scratching my head here.. :bonk:

03/27/09 - Receiced the SSN Card in the mail

04/15/09 - First Interview Appearance

- First Interview was cancelled

05/15/09 - Second Interview Appearance - Approved on the spot the USCIS officer had my passport stamped

06/01/09 - Approval Notice - Immigrant Petition for Relative (Wife) - 1-130

06/01/09 - Welcome Notice and Approval of AOS Application

06/30/09 - Received Green Card in the mail

He has received a B1 visa to travel to the US for some reason.

He has a sister who is a LPR in the US.

He wants to Adjust status based on this?

Answer: NO, it can't be done = you can't adjust status through LPR and stay in the US. Better stay at your well paying job.
