Hello everyone, I was recently approved on my K1 Visa application and I will be moving to America May 11th and I will be getting married June 5th. What I am struggling to understand is what exactly to do next. The package I received from the Embassy in London doesn't really help any on what to do next. I understand I have to adjust my status but how long after that should I adjust, after I am married. Does anybody have a link to send me with a guide line please?

You cannot adjust before your marriage... it is the entry into the USA and your subsequent marriage that qualifies you for the next step..

You should adjust status as quickly as possible after you get married. Please refer to question 6.1 in the VJ FAQ: http://www.visajourney.com/faq/k1k2visa-aos.html

You have up to 90 days after you enter the States on your visa to get married and file to adjust status. Basically, it's a good idea to file to adjust status as soon as you can after your honeymoon. As you are marrying within 1 month of arriving, you will have 2 more months but I suggest you send in all the paperwork within 4-6 weeks of your wedding so that you have time for it to arrive and you to receive your NOA1 - this will mean you are still legally in the country! You can find example forms on this site as well as a guide to AOS... I think maybe the person who posted before me put a link to that but I didn't stop to look! You can find the actual forms on USCIS website as always! Good luck emigrating and have a great wedding :-)

I-94 is typically provided on the aircraft just prior to arrival.... DO NOT open the package

The guides on here are fabulous. They helped 90% of VJers get through AOS and beyond so read them thoroughly.

I would reccomend preparing all the AOS paperwork before you get married so that you can file it quickly after marriage (obviously the marriage certificate will not be in hand straight away). The marriage certificate can take some time (2 weeks or more) if the priest/rabbi (whatever) has to mail in the signed marriage licence. In NY I was able to get the priest/rabbi (we had both) to let us take the signed certificate in person to get the marriage certificate. This enabled me to file AOS soon after the wedding.

As for entering the US, DO NOT OPEN THE BROWN ENVELOPE!!!! The immigration official at your port of entry will do that and only then.

Thanks so much, but do you know what the I-94 is exactly, is that inside this package that I can't open and have to give to an immigration officer?

I-94 is typically provided on the aircraft just prior to arrival.... DO NOT open the package

The I-94 will be stamped and stapled to your passport at the POE by the CBP Officer.

Ideally you want to submit your AoS package (I-485 App for Permanent Residence , Advance Parole I-131, Employment Auth I-765) as soon as possible after your marriage. You can complete these forms in advance and simply submit them once you have the marriage certificate and other required evidence.

One of the hardest post-wedding pre-AoS issues tends to be getting the vaccinations signed up by a Civil surgeon, so if your fiance can be looking up a local Civil Surgeon that isn't going to force you to undergo another full medical - just the TB skin test and vaccination write-up - that will make life a little simpler once you arrive.

You're also going to want to keep a couple of copies of every form and supporting paperwork that you submit. These always come in handy and save you reinventing the wheel.

From everything I've read on VJ and other immigration forums, you are out of status if you don't apply for Permanent Residence within 90 days of arrival (assumes marriage in between) but provided you aren't intending to leave the country between marriage and AoS, being out of status isn't a huge problem. This happens when people can't afford the $1010 fee for filing paperwork. Ideally, if you CAN afford it, do it asap and save yourself the headache of having paperwork hanging over your lives. You'll be too busy enjoying newlywed status to want that. ;)
