Spouse found medically ineligible for visa issuance under section 221(g). I'm currently in the process of gathering the required documentation for consular processing of our I-601 medical inadmissable waiver. So far I have managed to get the required endorsements from a HIV specialist at my Local Health Department, along with the Local Health Officer. The only hold up at this point is securing health care insurance for my spouse. (Just landed a job w/ USPS and I won't receive medical benefits until my 6 month probationary period is up.) :whistle: Waiting, waiting waiting... Married 12/2003, I-130 approved in 8/2004, finished NVC processing in July 2005, unsuccessful interview Jan 2006. :wacko:

I have searched this forum for HIV waiver stories and can't seem to find any threads. However, if there is anyone that is contemplating the process/ or currently going through it, there is some pretty good info. that a gentleman provided regarding preperation, the process, along with his success story.

Does anyone know where I can search to find out the stats on HIV waivers issued and the timeline for the adjudication?

coocoo, I've never seen anyone post that story to VJ, but there was a successful case a couple of years ago posted to avumb.

You can search the group alt.visa.us.marriage-based at google groups.

Proving the health care situation in the US was a big part of the approval.

October: Waiting

November: Waiting

December: In Security checks

January 2006: Waiting

February: Waiting..Contacted Congress

March 4th: APPROVED

March 17th: NVC posted file to London

March 20th: London Receives file

March 29th: Receive package 3

April 13th: London Receives package

April 19th: Medical - June 13th: INTERVIEW......APPROVED!!!!

June 20th: ARRIVE IN USA

Time taken for whole process 9 Months

AOS

October: 13th: Sent off AOS Package

November 3rd: NOA1

November 14th: Snail mail ~ NOA1 ~ Case moved to the CSC for faster processing.

November 14th : CSC has petition for me and my daughter.

December 14th: Biometrics completed.

January 17th: APPROVED AOS!

January 22nd: Green card arrives in the mail:))

Time taken for AOS - 3.5 Months

Finished for 2 years.

:) :) I recently was granted I-601. it was a very long emotional journey and had I known it would take so long I'm not sure I would have enbarked on this journey! 6 years in total!!!! The most important lesson I learnt from it all is that you HAVE to do everything by the book , there is no cutting corners. Once I had Major Risk Insurance I was on my way.Unless of course you can get insurance through your work. They want to know that you are not going to be a burden on the USA and are able to look after yourself medically. My wife had a greencard and applied for my waiver. I do not belive it is possible to get a waiver if you are not married or if you if you do not have someone sponsering you. I would also suggest that a good immigration lawyer is essential. I could have not done all this on my own. In short it does not come cheap!!!! Good luck to anyone out there trying this
