im in K3 then IR-I also approved

i have FRIEND who got the same situation

needless to say as the guys here mentioned that the IR is better than the CR-1 which is much much better thn the K3

if your I-130 is approved as u say and went to NVC and in process there so for sure and no doubt kep with the CR-1 or IR-1 if it has been two years since your marriage .

and what you will do is that you will call the Embassy and ask for a POSTPONE for your K3 interview telling u wait your CR-1

when they approve such a request ..at the CR-1 interview u will be asked to choose between them ..thts wht happened wz my friend

once u choose it ..the other is cancelled auto

If paid the $400 fee, then go for the IMMIGRANT visa, you can contact the embassy and get the K-3 rescheduled for a later date, if the I-130 (CR-1 IR-1) case makes it to the embassy before the K-3 interview the resulting interview will be for IR-1 or CR-1 visa.

OR you can interview for the K-3, and simply wait a few weeks for the IMMIGRANT visa interview and interview again for the IR-1 or CR-1 visa.

If you have been married more that 2 years at the time you enter the USA and become a resident, the resulting GC will be ten year card, IF married less than 2 years the card will be 2 years conditional card.

If i understand it right, that means i can still continue with CR-1 even after the interview for the K3. I will just have to wait for I-130 interview schedule and have an interview again? thanks for the clarrification on GC.

You can interview for K-3 and simply wait for the CR-1/IR-1 interview.

K-3 was developed to allow spouse to travel to USA and wait for their immigrant visa interview, OR adjust status. You can also wait in home country for the immigrant visa interview.

Note: Make sure you get your immigrations vaccinations done when you get medical done for K-3.

I am on my K3 interview procedure now, i just needed to submit additional requirements to USEM. But I also received notice from NVC that my IR petition is approved and the other day I received a notice regarding 'Bill to Agent" $400 processing fee for IR petition. My husband paid the $400 for the processing. My query is that, if ever the embassy issued me a k3 visa, what will happen to the IR-1 petition? Is it necessary to continue the IR-1, even i got approved with my K3? i got confused with the two :wacko:

You definitely want to finish the IR-1 and use that visa it is so much less expensive to do the IR-1 in the long run and you are not that far from completing that process. A 10yr immigrant visa would much better than a 2 yr conditional non- immigrant visa. Really consider this before you take the K-3. the difference is so vast I can't imagine there is much of a choice involved but that's just my opinion. Good Luck and hope everything works out.

You have a point. I firmly believe i can clear out my name, i have sufficient documents to prove we have genuine relationship. I just hope the decision wont be base on the interviewer opinions and beliefs. My interviewer in FU asked me why i married a divorced man? do i want to go to hell? do i read bible? do i know that divorced is written in the book of matthew? She even said, this is not what God wanted and planned for me, because if this is God's will, im not in her office in FU :crying:
