questions about AOS-Thanks!!!

Hello everyone,

I arrived in the states as a K-3.. now doing research about what i need to send to uscis for AOS..

I have a few questions;

1- Do I have to fill out I-131 form? If I need to travel to my country can i travel with my K-3 visa while AOS is being processed or do i need to fill out any form?

2- I have my birth certificate and marriage certificate both are translated in english.. Do I need anything else?

3-How many passport type photo i need to send? I have only 5 photos right now? will I need more?

4- As a K-3 holder do I need medical exam again?

5- G-325A form is the same form which we sent with I-130 right?

as I see I will need to prepare following forms and documents..please tell me if I miss anything or I am wrong.. I just want to make sure.. Thank you so much!

- Form I-485

- Form I-864 Affidavit of Support

- Form G-325A

- Form I-765 ( I want to work)

- Copy of my husband`s passport

- Copy of my K-3 Visa

- Copy of NOA2 for I-130

- Copy of my I-94

- Copy of my birth certificate along with English translation

- Copy of our marriage certificate -english translated

- Passport-type photos

No - Aliens present in the United States in a K-3 or K-4 non immigrant visa status can travel outside of the United States and return using their K-3/K-4 visa. If they have filed for adjustment of status in the U.S. prior to departure from the U.S., USCIS will not presume that the departure constitutes abandonment of an adjustment application

Congrats on coming in to the US!

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

1) NO K-3 is a multi entry visa valid for 2 years, read instructions included with form I-131.

2) Divorce certs?

3) 2 for I-485, and 2 for I-765 NONE from US CITIZEN

4) NO, unless medical for Visa was more than a year before filing I-485, some K-3 will wait to file I-485 untill close to 2 years of marriage BUT no more than a year after visa medical.

NOTE You will need to get vaccination records or get vaccinated or tested and have record transfered to an I-693 by a US Civil Surgeon.

5) YES.

Thank you guys! I really appreciate your response..

when i had my medical exam in my country, i got vaccinated and the hospital gave me a vaccination card.. Does it work here? Do I still need to do aything with US Civil Surgeon? also do I need to send the copy of vaccination card with my AOS papers or wait?

Did you get a DS-3025 at your medical? If not, then you do need to provide vaccination history with the I-485.

If it is the closed envelope that the american hospital gave me after my medical examination, yes.. I gave that envelope to the embasy at my interview.. Thanks for help..

I cannot say for certain the DS-3025 was in the envelope or not. My wife was handed it at the clinic. A K-3 visa has no specific vaccination requirement. The vaccination requirement is for an immigrant visa or adjustment of status. Many people get this done before arriving but it is not mandatory (except for London and Canada it appears).
