So my initial co sponsor has backed out and now I'm left scrambling to find a replacement. I'm wondering if my grandparents can be co sponsors? They are retired and draw pension and SS equaling around $30,000 and have a couple of properties with aprox value of $70,000. I don't know if this is possible since they are not actively working. I read that it is possible to be denied if the sponsor or co-sponsor is drawing government benefits. I would like to know if this is even possible before I spend all the time researching the requirements. They will be sponsoring my fiance and her daughter and don't have any other dependents.

My fiance will have an offer of employment letter stating that she will be working 40hrs a week at $12/hour but since I can't show any income on my 134, I'm worried about still having a co-sponsor. I've been living with her in Mexico for almost three years so I don't have any income to show nor did I file taxes for 2007 or 2008. I feel like her employment offer should be enough but I would still like to have an additional sponsor. According to the public charge information for Mexico, an offer letter of employment is acceptable as proof that the alien will not become a public charge in the US. Perhaps this is different from the rest of the world but things for Mexico generally seem different than most other consulates.

Also could someone please direct me to a link for the specific guidlines for the affidavit of support that shows what the poverty level is and so on?

Moving to consulate/embassy forum. I-134 is needed at the time of visa interview, NOT when filing I-129F

So this forum doesn't include things for the interview? Correct me if I'm wrong but the K1 process does include interviews and the documents required for the interviews. This forum is then only for questions about the 129F? Because I see lots of other questions in this forum asking about interviews and related questions.

And the mods, and organizers constantly move them to the correct forums, K-1 forum tends to be about what is needed to file an I-129F.

Many ask about I-134 in the K-1 and K-3 forums, leaving them there can confuse future readers into thinking that this needs to be sent to USCIS with I-129F, and many do send I-134 with the I-129F only to later learn that they need to put another I-134 together for interview.

Link for the poverty level I-864P However, the I-134 only requires 100% level, depends on the embassy, so it's best to meet the 125% level.

If your grandparents have enough income to cover the level needed, they can be co-sponsors. They do not need to be working actively. It appears if you count the household at 4, they make enough for the 125%

I think your misunderstood the thing about government benefits - (on the I-864)

Does Receipt of Means-Tested Public Benefits Disqualify me From being a Sponsor?

No. Receipt of means-tested public benefits does not disqualify anyone from being a sponsor. However, means-tested public benefits cannot be accepted as income for the purposes of meeting the income requirement.

Pension/SS is not considered means-tested. They would have to provide evidence under Supporting Evidence A. on the I-134 instructions.

Your beneficiary cannot be used for the I-134 to meet the income level. Only a sponsor's income can be counted. You can only count their income on the I-864 form. (there are a bunch of rules for that scenario).

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

You'll notice that it doesn't say anything about the I-134 and it does say that the applicant can submit a notarized offer of employment to satisfy the public charge requirement. Things seem to be a little different for Mexico.

Although, as I said above, I wouldn't feel safe having her go with only the employment letter and no I-134 co-sponsor since I can't show any income on my I-134. Thanks for your reply.
