I-797E Notice for adjustment of status

Hi All,

My husband and I are in the process of trying to adjust his status. We received a notice I-797E basically request for additional evidence for the I-485. This is their problem and I quote from the notice. "Delayed registration: It appears that the birth certificate for the applicant (name) was a delayed registration. Please submt secondary evidence to support the claimed date of birth and country of origin. Do not submit new or recreated evidence. All evidence presented should have been created prior to the child's 14th birthday. Examples of evidence are school records such as report cards, baptismal certificate issued by church, midwife, doctor's or hospital certificates displaying child's parents name and date of birth. Note: Affidavits may only be submitted if primary and secondary evidence are unavailable. and must be by two persons who were living at the time of the event."

The reason for the letter was during the initial stages when I was gathering information for my husband for the K-1 visa, he did not have his birth certificate and so went to the office in Ghana and got another issue of his birth certificate....however the date of birth and everything on the birth certificate and name is correct the only problem I guess that immigration has is the fact that the date the birth certificate was issued by the court was dated currently 2005 and they wanted to see a date that was issued maybe in the year he was born????

I do not have the supportive documents such as school records, baptimal certificate or hospital records to provide immigration so I do not know what other evidence I can use to show his date of birth?....I can get an affidavit from his biological father but his mom had passed away a long time ago...

TIME LINE

09/2007 - Gathered all documents for I-129F petition.

11/09/2007 - Sent I-129F

11/21/2007 - Package sent back to me( I forgot to sign one of my G-325A forms) I cried my eyes out but sent it next day delivery back to USCIS.

11/27/2007 - Received NOA1

02/13/2008 - Received NOA2

02/20/2008 - Package left NVC

02/22/2008 - Case uploaded into Ghana consulate data system

04/08/2008 - Packet 3 & 4 sent to fiance

04/16/2008 - Packet 3 & 4 received by fiance

06/24/2008 - Interview date (God blessings on this day)

06/24/2008 - DENIED visa at interview

06/25/2008 - APPROVED visa at 2nd interview with senior consulate

06/27/2008 - Picked up VISA

07/03/2008 - Fiance entered USA at JFK POE & Got EAD Stamp in passport

07/18/2008 - Married

08/07/2008 - Mailed AOS application

If you can't locate the supportive documents, you will have to find one more person, with the father, to write an affidavit. Like other family members, doctors or priests that know of this birth (and were living at the time of the birth).

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

I believe the reason why USCIS asked for documents showing his birthdate and other pertinent information is that because a birth certificate can be falsified anytime. Someone could just create a name so easily and then make up date of birth and then register it. So, if you can show and submit documents showing the same information like the baptismal, school records, etc, then that will tell that the person is really born in that date and year. Most of the time, a civil registrar where the person was born is the only authorize agency who can issue a person's birth certificate.

An affidavit from a person who know the birth of that person, in this case your husband, will be sufficient to support his birth. A witness who was there when your husband was born, maybe a neighbor, a friend of the parents or whoever.

Thank you soooo much for the reply and I will definately take the advice and ask my husband for someone other then his father that was there at the time of his birth to write an affidavit as well.
