Withdrawal of petition/ any consequences of withdrawal affecting future petitions

I have a question for all forum members concerning the withdrawal of a petition (I129F). It is currently in pending status for further review at USCIS (California). USCIS informed me that it will take at least another 12 months for them to complete their review. My question is what are the steps I need to take to withdrawal my petition. Can the beneficiary withdraw or I (petitioner) have to make the withdrawal request. I have read on this forum, that a letter needs to be written to the office that has my petition. How long does it take for them to grant me my request? Are there any consequences affecting beneficiary for future petitions filed by another person? Does it hurt her chances for future petitions if record shows that she has had previous petitions by another person.

Please help me out.

Only the petitioner can withdraw it.

No consequences. She can't be held responsible for what you (the petitioner) does to the petition.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

WARNING: Phrases in this post may sound meaner than they were intended to be. Read the Adjudicator's Field Manual from USCIS

Be aware if you withdraw a petition, and plan on petitioning for the same beneficiary, then it will raise red flags. It is, in a way, agreeing with the COs observation of the relationship. If you want to withdraw the petition because the relationship has dissolved, then yes, all the petitioner needs to do is write a letter to USCIS referencing the approval number. Some people get it notarized, although I am not sure if it is necessary. If the relationship has indeed dissolved, it should not have any bearing on whether or not the beneficiary gets a visa through another petitioner, but they should be ready with information if it does come up in the interview. My petition was returned by the embassy, and received on February 4th in California, and a well-known attorney who specializes with returned petitions, advised under no circumstances, should i withdraw. he, in fact, suggested that I file another petition on top, and reference the previous, with more concrete evidence. We plan on getting married in September and doing a CR1. If you want to withdraw because your petition has expired, no need, because the latest memo is USCIS is no longer obligated to review expired petitions. I hope this helps, and good luck in what you decide
