Hi, guys I have a question regarding affidavits. Does it have to be from a US citizen? Because my wife has a best best friend who knows her really well, but she is still on her 10 year green card. Also can they be from family members like my mother who for sure knows alot about us compared to our friends.

Affidavits can be done by anyone, not just USC. We followed the sample on VJ. We did have it notarized even though it is not necessary for an affidavit.

You may want to go to My Assistant above and fill in your timeline. It sure is helpful in answering questions.

It doesnt matter, however is better from US citizen. I should recommend you from friends and not for family.

The I-751 instructions say:

5. Affidavits sworn to or affirmed by at least two people who have known both of you since your conditional residence was granted and have personal knowledge of your marriage and relationship. (Such persons may be required to testify before an immigration officer as to the information contained in the affidavit.) The original affidavit must be submitted and also contain the following information regarding the person making the affidavit: his or her full name and address; date and place of birth; relationship to you or your spouse, if any; and full information and complete details explaining how the person acquired his or her knowledge. Affidavits must be supported by other types of evidence listed above.

I do not see where it says no relatives or you have to be a USC. It does not require you to put your citizenship, only your place of birth.

Please share where you find that it is best for a USC and should not be a relative. I send an affidavit from my son who lives with us. I personally think the more affidavits, the better. Not just two, but three, four, or five. It can't hurt.

I have read some comments of reply to some affidavits questions on VJ and saw a few of them saying its best to have a USC friend and not family member. Hope I misread or can find those post again.

I think anybody in your family can write affidavits there should be no problem with that and instruction does not say that it should only be made by a US Citizen or green card holder.I did not submit any when I filed my I-751 because my husband and I thought that we have enough evidence already.Goodluck to you.

Affidavits are very weak evidence in my opinion. I never sent any for my wife's AOS or removal of conditions - and we were fine. If you have sufficient evidence of co-mingled lives e.g. Insurances, bank accounts, credit card accounts, tax returns etc. - then you do not need affidavits, but if you lack evidence of co-mingled lives then and only then send affidavits. An affidavit is no better than the credibility of the person writing the affidavit. And that credibility is measured in the eyes of the person reading the affidavit.

If you happen to personally know an immigration judge, and if you can get that judge to write an affidavit that includes his credentials as an immigration judge and that says he knows you and knows your relationship to be bona fide, then I'd suspect that affidavit would carry lots of weight.

An affidavit from a government official, member of the clergy, or other person in a similar position of respect might carry more weight than an average affidavit.

But an affidavit from a random person probably doesn't carry a huge amount of weight. Sure, the person YOU get to write your affidavit is a very honest person, but how does the adjudicator reading your I-751 distinguish your affidavit from an affidavit faked by some lying scum marriage fraudsters?

Notarization may be somewhat helpful, as it at least demonstrates that someone showed up at the notary's office and produced an ID when he/she signed the paper. It separates your affidavit from one that was totally concocted using a fake name and fake signature.

But regardless, I'd guess that many people with the morals to commit marriage fraud have at least one or two friends with similar morals who would write a nice looking false affidavit.

Your job is to come up with evidence that the fraudulent couple would NOT be able to come up with easily.
