Well, they took MY WIFE away from me and wouldn't allow me to attend or see or watch what was going on.

I'd say that is an arrest, but that's subjective based on my opinion of how such behavior ought to be worded.

I've got some apt.s with immigration attorneys and some help here in Seattle- and I'm going to ask the Sofia, BG Embassy why they issued my wife a B2 knowing she was married and had a husband and the situation there is the same now as it ever was, except I no longer have a job. And why that same B2 wasn't good enough here for the visit we had planned. Of COURSE I am going to TRY and get my wife more rights to come and go and visit her family there- with 6 months I can MAKE money here and PAY for us to come and go; with 3...??? in THIS economy???

They should never have issued a B2 10 year visa for a married women with a child, especially if the SAME CONDITIONS that existed at the time of issue are NOT ACCEPTABLE at the USA POE's, so ANY and ALL travel arrangements and intentions can be messed with by the POE people!!! That's not simply arbitrary messing- this cost me even MORE money to fix, now that they have screwed up our airfare!!!!

I'd love to file a lawsuit, I tell ya what.

My job collapses and my COUNTRY screws up my FAMILY?

I sure hope the BG embassy can fix this and fix it fast. I don't have money anymore to whimsically fly to the other side of the world willy nilly again and again, and I DO NOT BELIEVE they have the right to split up my FAMILY. After all the rhetoric about family values being so important in the USA. Wow I am pissed now.

I'll appraise as my story goes and new information comes in.

On principle I see my mistake, but in the real world, I didn't have time to become an immigration specialist for my family- I needed to try and make us money as the economy was collapsing so we wouldn't be homeless.

Argh.

The visa was issued by an agency of the US State Department and the Port of Entry is the jurisdiction of Customs and Border Patrol, part of the US Department of Homeland Security. They don't exactly work together and a visa is not a gaurantee of entry to the US. I think you'd be better off using your energies working on your wife's immigration process than complaining about the visa she already has. You might just get it revoked.

You set off some red flags, and they took her for a secondary interview, which is normal, and is actually listed in what they can do when you come to the POE.

That is great your talking to some lawyers! Her B-2 was valid and is was good enough for her to visit, they gave her 90 days. Remember, the burden of proof lies with you to pass the POE inspection, not the embassy or the POE officers.

It was acceptable, they allowed her in on it. Same as above. As PushBrk said, the visa gives you the right to apply for admission to the US at the POE, not to actually get in.

You won't win, IMHO

Your country did not screw you up. You came here with wrong visa, intending to AOS, (based on your post here and subsequent answers), so the blame lies with you. What you should of done is file for the DCF then use that visa to immigrate to the US. However, the is in the pass. Don't forget what you wrote in your first post on how great the US is.

I doubt the BG embassy can do anything to fix this. Contrary to what you think, they can split your family up, because the law is the law.

Good, you acknowledge the errors. Now you need to put this aside and concentrate on getting the correct paperwork done so you can minimize the delay.

Argh.

Sorry to be so straight forward, but you seem to be lashing out to find someone at fault here. I emphasize with your plight, but complaining about it won't make it go away.

Your doing the right thing talking to the lawyers. They may be able to work out some sort of deal, but be prepared for your wife to leave back to her country, till the paperwork is done.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Well for sure, I'm lashing out a bit.

Remember, I can love the USA but I don't need to love everyone nor someone at a border who wants to split my family up and reduce the time I have here to find solution and make enough to cover expenses- he saw my computers and my personal gear, and that my wife and child and I, outside that, had only vacation belongings- enough for a few weeks, or a few days of clothes! Human beings can not get items in or out of places like Bulgaria in the mail- anything of value is taken/stolen or taxed at 20% original value if you try and send it normal (trust me on this-I've lost over 12k USD in belonging trying to ship from the USA to Bulgaria- most never made it until I had my family in the USA send small stuff in tiny unmarked boxes- the system there is too corrupt and no consequence for mail fraud or theft).

Without getting off track too much more, I didn't intend to default of violate her B2, simply I NEEDED 6 months to make ENOUGH to support my family, and the POE officer reduced that to barely something to even cover the cost to get here. I'm furious. I'd have been worse if he had deported her for sure. But of course, it's simply the law.

BUT

The real point isn't blame, or my needing to vent with people who might feel the same frustration but rather THE POINT is

Getting my wife here as a citizen/rights of a USA citizen, at SOME POINT[/i], and

...the sooner the better

and

...with the LEAST amount of time separated from our baby daughter.

I had to promise my wife we'd return in 6 months to visit family, so it was a FOR SURE thing that we'd not be sneaking in and COS'ing.

HOWEVER

I wish I could do a COS now. Why? Because I don't have enough time to make enough money to take care of my family or do this.

There's no architecture work, and no construction.

We call the embassy tonight, but it sounds like simply the I-130 route, K-3 and some separation might be inevitable, with my now limited budget.

I can work on the other paperwork (financial/sponsoring, etc). I have an apt. for immigration legal help in a week as well. (probably you all will know almost as much though, from my reading the threads here)....

So if I begin to file for an I-130 or the 129 (I'll be reading more tonight about how these things work, from posts here in the forums) does that help or hinder things?

Would it help or hinder a DCF, if you know (or depends on the embassy, right)???

Again thanks for the kind words and it's a REAL relief to know many of you have been right here.

Forgive me if I vent a bit. I really was blindsided. I'm soooo incredibly worried about my little girl missing her mama...just typing it I'm going to fall apart.

She's the apple of my eye.
