Hello All.

I got married in January of 2007 and got my Conditional Green Card in June but my wife and I are not living together since October 2007. The reason is because she when abroad to complete a school program to graduate from college and she had to stay away for 9 months; at that time we stayed in contact but i have no much proof of that since she called from public phones also we used to chat online a lot, after she completed school and graduated she came back in June of 2008 and stay for three months during the summer and left again for another program so she has been gone since September of 2008 until now, also she is planning to stay for one year since she got a Government contract job for that country.

Now that I have to apply to get my conditions removal, I'm afraid to get denied since we haven't spent the majority of our marriage together

If anyone here have some advise Will be Deeply Appreciated

I'm not trying to be mean but it sounds like a contract marriage. Are you serious? Who in their right mind is going to believe that your marriage is real?

I love her and we want to be together when she finish her contract job abroad

well if u wanna be here when she comes back, then u better start gathering all the evidence that you can. your story sounds weird but for immigration purposes, you gotta get it right before you go in for your interview.

I agree with the other posters your evidence were too light you need more from what you have posted here and do you have a child together?That would be a very good evidence.It doesn't really sound right that you and your wife have not been living together for long time immigration officers might think that your marriage was a fraud.Goodluck to you and hope you will get through this.

I am not here judging you, just to give you my thoughts.

if your country is not going to stay in USA, since she got a job overseas, it shows that she has no intention to stay here. What's the point getting the green card?

and since you are moving there anyway soon or later, you shouldn't be worried too much, at least you guys will be together eventually.

Apartment Lease that both of you signed , and she is not even staying here during most of the lease period, that doesn't good to me .....

and i agree with motu. filing jont income tax is indeed the "must have" document, the very basic document.

Anyway, i will suggest you to file it anyway, so that you can get the one-year extention, and she is still able to come back to USA incase something goes wrong in that foreign country,

but do remember, the extention is only good for 1 year, and she needs to be here provide fingerprint( normally within 3-6 weeks after they received your application

Anyway, i will suggest you to file it anyway, so that you can get the one-year extention, and you could still come back to USA in case something goes wrong in that foreign country after you move there

In my opinion, eventhough, she wasnt here, you should have made sure most of your life was still joint financially. Since the apartment lease was in both names, the utilities should have been joint also...

You should have established a joint account before she left. What you can do right now to salvage the situation, is start adding her to every part of your life. Get joint accounts, you mentioned you have a job (do you have life insurance - is she listed as your beneficiary? if so, get a letter from your job stating so), add her name to utilities, credit cards, car insurance, savings account etc then file eventhough, they would be recent documents but you would have lots of papers in both names. You are not filing until maybe may or june, right? So you have very little time - you need to move fast.

Worst case scenario, they will call you in for interview, when they do then you guys have the opportunity to prove that your marriage is real....make sure she will be around for that.

The situation seems fishy to me too, but I had an in-law they were very happily married but lived in different countries for 3 years. She moved here when she was pregnant and he was trying to come here and join her, it didnt work out, they kept trying for 3 years and US embassy wont allow him to come here. Finally, they gave up the American dream and she moved back to England to live with him and they live together now happily. If I didnt witness that personally, I would have denied and said its impossible, but sometimes love can cross oceans even if you dont see the person.

Also, I had a friends uncle, he moved here, family was in Africa, he lived here for 6 years, a company filed for his papers for him and when he was a citizen, he filed for his family and they arrived here 3 months ago........can you imagine?! It sounds ridiculous, but some people do it.

So I wont judge you because I can understand the situation....you just need to be proactive about this....start adding her to everything, do eveything possible to get as many papers as possible in both names and send it in.

Very good advice.... just do what ever you need to do, but you realy should be proactive

Time went thru very fast, our plans as a couple has not been very succesfully and I live in the US and I was planning to move with her for a few months but my financial situation didnt let me do that and now she is working abroad and I'm here in the US

About the TAXES, there is nothing I need to hide, the reason is becuase like I said her dad does that for her.

Last year i was trying to file together is she said I think my dad already did that for me because you know we have some stuff under my name thats why we need to do it that way.

It sounded to me that the point they were trying to make was that the father is doing the taxes because some fincial stuff is in her name and that sounds sketchy at best. Not that yo uare trying to hide anything but that he might be!!

I also have our marriage certificate, proof of cellphone bills, and some other bills to her to our address,

copies of driver state ID and passport

but the taxes documents are not filled together because her dad takes care of that since they have some business under her name, they said they have to do that

TAXES!!! I don't want to alarm you, but Taxes are a major evidence!!!!! you are going to need (maybe) affidavit from your father in law explaining why!

I think you should gather any or all info you can, affidavits, cards, letters... anything at all

I can understand your situation, many people outside of this immigration situation have marriages that are not perfect in terms of being together all the time etc. and it does not mean it's not valid although some arent! This forum is about immigration, not marriage counseling or advice!

My mom and her husband currently live in different countries for financial and career reasons, visiting each other as often as they can and speaking to each other practically all day long! People judge their married but I see it stronger than many where the couples are together everyday. They enjoy each other thoroughly when together, are happy , which is more than I can say for some marriages!and will move back together once the economy looks up

With that I wish you good luck and as long as you have a bonafide marriage, get all the documents you can to prove that! However, I suggest trying to establish anything else you can during the wait as you may get a RFE. :wacko:
