Hi everyone:) I am trying to fill out form I485 (Application to register permanent residence or adjust status) and I have a small question. What box should I check on part 2 question. I came here in the US on K-3 visa and I am not sure if I should check the 1st or the 2nd box.

Your help is greatly appreciated. Thanks:)

It should be letter C. K-1/K-3..same..both married prior to filing and both have marriage cert. Im filing for AOS too. Also i have K3. :yes:

March '05 - met George online thru common friend

March '06 - He went to visit me in the PI first time

May '06 - He came back for the family reunion and proposed for marriage

Nov. '06 - came back to prepare for our wedding

Dec 16, '06 - Wedding Day!

took at least 6 or 7 months (as i remember) for the K3 and was approved!

Nov '07 - I arrived in the US

together again with my gwapo, lol

April 9 - mailed in AOS package

April 13 - NOA for EAD and AOS

April 22 - Biometrics Appointment and will be on May 7 in Jamaica

May 7 - Biometrics done!

May 14 - Got an RFE dated may 9 - joint sponsor :-(

June 5 - they received our reply to the RFE

June 10 - EAD card production ordered, YAYYYYY Thank u, God!

June 21 - EAD card received in mail.

...and the waiting continues for the interview date...... will update later

so i got my interview date, and guess when??

Sept 10 - yaayyyy and its my hubby's Birthday! Approval would be a GREAT bday gift.

Sept 10 - got APPROVED! Indeed its a GREAT Birthday gift! " Card production Ordered" Yayyy

Sept 18 - Welcome Letter received!

Sept 19 - Green Card in hand!

Thanks ailyn:) However, it says on letter C that "I entered as a K-1 fiance(e)..." Our visas are under K-3 category. I am thinking it is letter A since we got the NOA2 for our I-130,isn't it?

Thanks ailyn:) However, it says on letter C that "I entered as a K-1 fiance(e)..." Our visas are under K-3 category. I am thinking it is letter A since we got the NOA2 for our I-130,isn't it?

After giving much thought about it, i guess u r right. we will go for (a) and since in the guideline we have to submit also a copy of NOA2 for I-130, so it really makes sense.

At one point i thought of checking (h) and just put there "entered as k-3 visa holder" but now i see (a) makes better sense.

It is "A" because your adjustment is based on a previously filed petition that will result in an immediate visa number

I am almost done with filling out the forms.. I am a K-3 holder too.. Did you file form I-131 and I-693? I just want to make sure on a few things..then I want to send my AOS papers next week.. Thanks!

K-3 does not need the I-131 unless the visa is expired

K-3 does not need the I-131 unless the visa is expired

K-3 does not need the I-131 unless the visa is expired

If the medical is more than a year old on the day you file, then you do ... otherwise you do not
