Hi Guys!

I have a few questions that I haven't been able to find answered before - so I thought I'd ask and see if anybody has any advice/similar situation.

So. My husband (Italian resident, Jordanian citizen) and I (USC) have already applied for the I-130, had it approved, sent in the DS-3032 and are awaiting the DS-230 packet (on his end).

On my end, I've received the AOS of support bill and will pay it online later this week. My question comes with the I-864 packet that will come later.

I graduated last May (2008) and was a student the previous four years. I never filed taxes (as I made very little money with odd summer jobs and didn't have to file). I've read on the forums that I can provide proof of my reasons for not filing (being a full-time student and making below the threshold). So I'm not too worried about that part.

However, I read that I need to supply an employment letter. I'm not currently employed. I'm in Italy with my husband (although I know I'm technically supposed to be in the US) taking a non-credit Italian class at a language school here. I don't have a job in Italy or the US, and would not be able to get an employment letter. I've applied to positions like crazy back in the US and would return the second I get a call back or interview, but nothing has appeared as of yet (and the economic crisis isn't helping me get a job....).

This summer/fall I'll be taking classes at a community college to fill in some courses I need before I can get teacher certification here in Arizona. So my question becomes this - do I NEED to submit a letter of employment? Or could I submit proof of enrollment once I register with the community college in the USA in lieu of employment? I don't think I would be able to do so with my classes in Italy since I think I'm technically supposed to be waiting for him in the US..

For other I-864 info, my co-sponsor will be one of my former professors. If I don't have a job, will his income threshold increase since I'm not working? Or would it be the same as before? I'm quite confused about all of this, so any help would be greatly appreciated!!

You dont have to supply an employment letter if you are unemployed with a co-sponsor

I wouldnt worry about proving it as employment since you have a co-sponsor BUT, I think you will need to prove domicle and intent to go live in the US, the registration will help with that. I dont know much about this, other than readng peoples experience. The consulate will not issue a visa if you cant prove you have intent to move back to the US.

It will not change anything. He needs to meet the requirements for 125% above poverty for the family size. That means his family and you and your hubby.

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. Once you walk a mile in their shoes you will understand and be heard.

Agreed with Lisa, if you are not working, you don't need a letter of employment. You also need to meet the 125% poverty line requirement with your co-sponsors.
