My husband has been in the U.S since December 08. We have not yet filed for his A.O.S, we wanted to apply for his work permit first so we can gather some money to pay the fees. Is that ok? Does anyone have any advice on the process of A.O.S and work permit? I had a immigration specialist try to help me before and all he did was take my money and did nothing! So I am trying to do this myself! thanks for all the help!

All information tips on things I may need to save for our interview when A.O.S is processed so I can get everything from now. I know for the K-3 visa they wanted proof of our relationship.

I don't know if you can apply for EAD without simultaneously applying for AOS. This might be really bad advice, but if you guys have a couple credit cards with a total of a couple thousand dollars in limit then I would get a cash advance for the $1,010 off of your credit card and use it for the AOS fee. You can go to any bank, give them your credit card, and ask for a cash advance, the fee is maybe 4% ($40) but you don't pay that up front. Then you just have to make the $15 minimum payment per month for three months until your husband receives his EAD and finds work.

There is no point in applying for an EAD before applying to adjust status. Before his AOS application, you would be applying for your husband's EAD based on his K-1. They will only issue a temporary EAD that expires when your husband's I-94 does. That is somethime this month. You wouldn't even get it until after it expired.

When you submit your husband's AOS application, you are applying for the EAD based on the AOS application. This results in an EAD that is good for a year.

You can apply for EAD - separate fee $340 plus a biometrics fee ($80) so that's $420 - $420 you will essentially pay again when you do AOS since EAD is included in the $1010 (plus biometrics) fee. :thumbs:

yeah but doesn't the EAD have to be based on a concurrent filing for adjustment of status? I doubt you can just apply for EAD without some sort of justification. besides it not making any fiscal sense, it i idont think it would be a wise idea.

A K3 visa holder can file for EAD before applying for AOS. A lot of K3 Visa holders dont want to file for AOS until after their 2 wedding anniversary so that they get a 10 year greencard and dont have to pay for Removal of Conditions on a 2 year greencard.

So the cost of filing for EAD before AOS for K3 visa holders is less than the cost of filing to remove conditions, It also means they can earn money to help pay for AOS and their income can be included in the Affidavit of Support.

The worse thing you can do is use a credit card for a cash advance, it will cost you way more than the $40 quoted.

I agree. Not only is there a transaction fee but the interest starts right away (no grace period) at like 24-27%. :blink:

Some cards allow you to do a deposit into your checking account. They count it as a "balance transfer" at a lower promotional rate usually. The rate only lasts 6-12 months so you'd have to pay it off by then or the interest will increase substantially.
