let say my boyfriend has arrears or back child support, do u think he really cant get a passport?

How much is he behind?

The State Department denies passports to non-custodial parents who owe more than $2,500 in child support. Once the parents make good on their debts, they can reapply for passports.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

he said is paying $80 monthly for back child support. still havent asked him how much it is really? i really dont want to dwell when it comes to his child support cus i dont want him to think i dont understand him. he is non-custodial parent.

From what I understand, having a lot of unpaid child support can prevent you from getting a passport, which is apparently why he can't travel to meet you. Have you two thought about meeting in Canada? If he can't get a passport he won't be able to go to Mexico either, but Canada may possibly be an option, I'm not entirely sure about the rules for travel. I know years ago my family and I went to Canada to the Niagara Falls and we did not have a passport. This might be something to check into.

You must have ALL your bases covered before saying that there is no way for you to meet in person.

Not to mention if he is not caught up on back-owed child support, how does he propose to support you and do the financial information needed for the I-134/I-864???

passports are issued by the federal government, not the state.

One potential consequence of NOT paying child support is passport revocation or inability to obtain one. The process of obtaining a first time passport starts at the post office but then the application is sent to DOS. Chances are, if this US Citizen has not been in arrears on his child support, he can obtain a passport.

Ok, so he is paying "bacK" support, so he is behind in his payments. You really need to find out how much he owes in "back" payments in total.

If it's more than $2,500.00 he cannot apply for a passport.

You have to dwell on this, because of your situation, you will have to resolve this issue.

You probably will not be able to get a visitors visa to the states. If he owes more than $2,500 back child support, he can't get a passport.

They will not give you a waiver for not meeting - he can simply pay his back support and get the passport, so unless he does this, you are probably out of luck.

Sorry to be so direct, but if he owes "back" child support (more than $2,500), the law was made so he actually pays it before he can get a passport.

No it's ok. I dont mind if you are being so direct , i appreaciate it. Does he need to pay all the arrears before he can apply for passport?

Then have him pay it off, then apply for passport.

Then he can visit you and you meet the criteria of meeting, apply for K-1.

Even though the Law is 2500 or greater most child support departments will require paying it off totally before issuing a release. Once he meets that requirement he then just applies for a passport with no problem. this is an issue you should take care of anyway to start your marriage on a financially sound footing. Being behind in child support will keep you from being issued a passport if the amount behind exceeds 2500.00 and also if you have a valid passport and fall that amount behind your passport will be suspended. that is federal law. So is it a reason for a waiver that is hard to answer, it will depend why he fell behind etc. be prepared to explain it on the waiver application with supporting documents. Oh thank you so much. I will talk to him regarding this, maybe he doesnt know about this, 'cause all his life he never had a passport.

I remember reading an article about this in either the Times or the Wapo some time ago, the State Dept will not issue passports to people who are majorly behind in child support. I'm going to look for it and will be back.

I agree that it is important for him to at least do everything he possibly can to pay off as much of the child support as possible before the two of you get married, regardless of him needing to pay it off for a passport. However, assuming it would be impossible for him to pay the amount off....you can still try for a waiver for the 2 year meeting requirment.

As others have stated, you will have to at least attempt for a visa to the US. If they deny you then you CAN use that as evidence for your waiver. If he is able to travel to Canada or Mexico (I guess not by flying, but maybe he could fly to the nearest border town and rent a car and drive accros), then you should try to apply for visas to Canada or Mexico as well and you could also use that as evidence.

All of that being said, I beleive it is a lost cause. They hardly ever approve these waivers and I would imagine that someone oweing a lot of money would be the least of the reasons they would approve! Just to give you some perspective, there was a couple a couple years back that could not apply and were denied a waiver. The American man was confined to a wheelchair and could not fly for long periods of time. I cannot remember where his fiancee came from, but she was unable to get a visa to come to America as well. They were denied the waiver (even though he had medical proof that he could not fly for such an extended period of time). They were denied on the basis that they could have met in a third country closer to the US where the man could have flown. So, since they type of a case was denied, I cannot imagine that yours would be approved. BUT, if you care to try, you are always welcome.

I think the only chance the two of you have is for him to pay off his child support -or at least the majority of it.
