Hello all.

I am a US citizen and would like to apply for my wife to get a green card.

We know that we have to submit I-130 and I-485, but do we submit them both together? What are the forms we need to get started? Do we submit I-130 first and then proceed to submission of I-485? Very confusing stuff.

Do we need the following?

G-28

I-485

I-130

G-325

I-693

I-94

I-864

WR-703

and any other forms?

in what order do we fill them out? Please help, we are very very confused.

She has no status, after she filed for divorce from her ex husband. she was victim of domestic violence but her case didn't stand a chance. So she has no status right now but entered US legally.

Did she have a visa before? If so what visa was it? Does she have an I-94?

Yes she has an I-94

Also, she came here from Europe and as she has a European passport she didn't need a Visa.

Is there a date stamped on the I-94? How long has she been here? Did she start aos proceedings with her first husband? How long between husbands?

Yes there is a date stamped on I-94

She's been in the US for 3 and 1/2 years

Did start aos with first husband but after he cheated on her and abused her, she filed for "spouse abuse" but case got denied due to lack of documentation (police report, etc...)

We got married in last quarter of 2008 , but have been together since August 2007, her divorce was finalized in July 2007.

Given that your wife previously had a pending AOS petition, and a VAWA claim, I think you'd best be served by obtaining legal consultation before you file any paperwork. You want to make sure that the previously filed petitions are completely closed, before you file any new paperwork.

IN your situation you would file the I-130 and I-485 simultaneously, but you really do need to talk with a lawyer to make sure that given your wife's previous petititions, there is no 'active' petition of your wife's with USCIS.

If the case is closed, no problem. Because you can not apply for 2 different AOS at the same time.

I mean from each USC Husband.

Let me clarify here about filings of I-130 & I-485.

If your spouse is USC, you can do as follows, everything is all up to you, depends

if you have enough money to file or if you have gathered enough supporting documents etc....

Option 1 (Filing Subsequently) : File I-130 first & then later on file I-485

(Make sure you include 130 NOA with 485 package.)

Option 2 (Filing Concurrently) : File I-130 & I-485 at the same time.

Current Fees : For I-130 -------> $355 For I-485 ---------> $1,010

For example, I have done Option 1, look at my timeline please.

I-130 mailed 01/13/09

I-130 received by USCIS 01/16/09

NOA1 Mail for I-130 received 01/22/09

I-485 Package mailed 02/17/09

I-485 Package received by USCIS 02/20/09

NOA1 Mail for I-485 & I-765 received 02/26/09

NOA2 e-mail for I-130 Approval 03/03/09 (47 Days)

NOA2 Hard Copy of I-130 Approval received 03/07/09

Biometrics App. Mail Notice received 03/09/09 (App. Date 03/24/09)

NOTE : I DID NOT APPLY FOR I-131 (AP).
