Hello,

I had a few questions I was hoping I could help cleared up for me. Any help you can provide would be really appreciated :star:

To begin, I got married while overseas last year, and now I'm back in the States working. My job pays over the 125% poverty level, but not by much. I only have a few paychecks to my name so far, and most of them haven't even been "Full" checks due to changes within the company. I had my boss write out a letter explaining my pay however, so hopefully that will bridge that gap. Now for my taxes, my last year of taxes only shows I made a couple thousand dollars since I spent most of the year abroad. Because these numbers don't look too promising (even though I am currently set to make over the 125% mark), I decided that maybe it would be best to have my father fill out a I-864A document just to be on the safe side. My mom isn't working, but my dad is, and I'm currently staying with my parents and with the addition of his help, we are definitely over that that poverty threshold.

So, I went ahead and made copies of my W2 for the past 3 years, and I made copies of the 1040EZ documents. I also made copies of my dad's W2 and his 1040's, but here's the tricky part. My mom is on all of his tax forms as his spouse, and she was making money those past 3 years. So, to show why the 1040 amounts are different than the W2 of my father, I need to include her W2's as well right? So now I have printed out both parent's W2's and their combined 1040 document, and i have like 30 pages of documents. Now that I included all that, it kind of looks like my mom is also a sponsor, since all her W2's are there. Is this a problem? Also, do I really need to have my dad's boss write a letter? Will I be okay without that letter as long as I include proof of his pay for the last 3 years? I also don't know if he has 6 months worth of paychecks saved up :(

Finally, on Part 5: Sponsor's household size on the I-864... I should still list that household size as 3 right? My immigrating spouse, my father, and myself? I don't need to add my mom in there as I didn't intend to have her as a part of this sponsoring? Or do I have to as she's living here as well?

I had this same thing happen to me. Don't worry about your mom being on your dad's taxes. My parents filed jointly as well. Just make sure when you list your dad's individual income, it is his individual income, and where it says gross income, write the total amount your mom and dad made (what would be on his tax return). Since you are including your dad's W-2's, they should state his INDIVIDUAL income, not the joint one. And if you want, you can also have your dad's employer write a letter stating what his individual income is. When you write the gross income in the 1864A (your mom plus your dad) make sure to write next to it in parenthesis (jointly filed). This way you don't need to include your mom's W-2's or anything.

The household size would still be 3.

Since dad is the joint sponsor, you include the full tax returns complete with all supporting documentation but you state only HIS personal income by totalling HIS W2 forms. Do not state his income as the gross for both parents. Your own household size is two and dad's would be at least three, more if he has dependent children. Mom is part of dad's household but you are not, unless you are his dependent. Have your dad file an I-864, not an I-864a.

silly question maybe, but if all the income of the father and mother is in either his name or both names (ie stocks and bank balances) then would it be ok to put the individual income as the same as the gross for that year?

because i am in this situation where US hubbys father is on every document as the income earner, but two of the forms have him and his wife.. do i split the asset in half, or just make it all his income.. koz technically it is?!?!
