Lisa this was very helpful cause the hubby & I were trying to figure out how to avoid paying that $1010 fee, if possible. Now for the 2 years clause you mentioned below - is that 2 years from date being married, 2 years from date of K3 being issued? 2 years after arrival to US? Sorry for the silly question ...Thanks!

What additonal fees have to be paid if you file the K3 visa? From the looks of things the K3 are getting approved around the same time as the CR1.

After entering the US, the k3 visa holder has to apply to adjust status. The total cost is 1010.00

If you choose to file for the Employment authorization before the AOS(to be able to work before AOS, and wait for the two year anniversary to file AOS as to get a 10 yr card, which will save you costs and headache from lifting conditions 2 years later) that is an additional 340.00

so the difference is:

CR1 total after approval:425.00 + medical

K3 total after approval: 131.00 + medical and then 1010.00 for AOS

Well,

you cant avoid paying it all together, but you can "delay it" :) It's 2 years from your wedding anniversary. So, as long as USCIS has received, but not approved your case before the 2 year wedding ann., he will automatically get the 10 yr card after the AOS is approved.

My husband had a fantastic idea to do some volunteering while waiting for EAD. This will keep him occupied and also allow for some networking for potential jobs once he gets the EAD

Waving at our lovely group! :luv:

Ladies (and Que) ... all I can say tonight is remember that "together" (I was late to the party) you all made it this far as a team. When I came to this little group, I was so impressed and touched by the support system you all had here. This "team" is still here, and I am encouraged to see all the continued warmth and support for one another.

What I'm trying to say is ... that even though many of us are facing another challenge through this immigration ####### ... [b

i have to say i still feel greatful that everything has been ok @ my part. (except for the part my cr1 process have been weird and delayed.. so i decided to abandon that as i got sent the DS3032 twice and considered what other weird stuff comes up before I pay any CR1 fees & thought about the agony). Others have a tougher situation as i do cuz you guys probably do not see your partner all the time. But im impressed at how well everyone are posting all the time and keeping up with everyone. i know i dont post all that much compared to others but all your comments have helped me educate myself in the whole process and make the best decision (at least i think i am making the best decision.lol)

What happened with ur DS3032 that got you to abandon CR1? Is it because it was sent twice?

Hey everyone...sorry I was busy trying to put together all the supporting schedules for my taxes, trying to get them filed by early next week, so that headache was of of my plate. I spent 1.5 hours looking for a 1099 that I could have sworn to have put with the rest of the documents.

Talking about taxes, I called IRS yesterday and they confirmed that the best way to file my taxes this year is to mail in a W7 form for my hubby along with a certified copy of his passport biographical pages. So looks like I will be filing MFJ.

NVC update: I finally got through right before going to sleep at 11:55 and my call was answered shortly after midnight by a very nice rep (was surprised since it was so late). She informed me that my AOS and IV bill will be generated together and sent to the lawyer. I was glad to hear they won't be part of a separate process. I am hoping the bill gets sent by tomorrow or end of the week so we can hopefully wrap everything up @ NVC first week of April and get a May interview. And I know I am pushing it but still room for hope ;)

You wish ! Your husband will be eligible to file for citizenship in 3 years and you will be back at the mercy of USCIS (hopefully for one last time). As they say nothing is certain but death and taxes. In my case USCIS can be added to that list. I have been dealing with them for the last 15 years (having gone through all the possible phases including student visa, work visa, green card and then citizenship). Just when I thought I was done dealing with them for good I decided to get married and it put me back at square one. We will be doing the K3 and so I will have AOS, EAD, AP, removal of conditions and citizenship for my wife to look forward to in the future ! :lol:

My accountant says I cannot apply for a TIN for my wife since she has never been to the US. His recommendation to me was to file as single and then do MFJ going forward.

I have a TIN and I have never lived in the US...for the last 2 yrs my hubby has filed as MFS.

Yeah, im going to look into that, but filing MFS means I pay more in taxes. My accountant states that for the year I got married I am still allowed to file Single as a grace period. I guess I need to call the IRS and confirm.

Called NVC today and the rep informed me that AOS is usually generated in 1-2 weeks and we should be getting notification this week! New day, new BS :angry: I guess I should be happy that they have changed the script a bit.

GS keep me iformed if you receive AOS & IV bill and I will do the same...
