concerned about the support issue....

Although my interview is FAR into the future, (so far that I can't even see it right now), the only concern I have is the affidavit of support. Tim is on disability, and definitely will fall short of the required amount. (Which I'm totally confused about because I thought it was 125%, then I read 100%, and he's not military, never was, *heads spinning with this*). Anyway, I mentioned about a co sponsor, but I don't think that sat well with him. I think the way he looks at it, he's petitioning for me, so he should be able to support me. ( I can really appreciate how he feels).

He will be with me at time of the interview, and what I'm thinking is that if he had all the right documents of a co sponsor, (bank statements, tax returns, etc) with him, but NOT included with the package to present the interviewer, just going on his alone, then if it was said to me "everything is good, but you need a co sponsor", I'd be able to go get it then and there.

Not really sure I'm asking a question here, (it's the blonde in me), but just seeing whether or not this would be a good idea. I know we need someone else. It's not like they actually need to support us, but it's for the approval of the visa. Tim owns his house and holds no mortgage, so I hoping that might be a factor somewhere along the line.

Oy ve!! This whole process sure does question ones sanity!! :wacko:

Timeline

There are a lot of threads on here regarding the affidavits of support. Take some time and read through (again). After the headache goes away :) , here are my two cents:

In the K1 process there are 2 (I-134 and I-864). The i-134 is not a long term obligation that ends when you adjust status. The i-864 is an obligation for 40 credited quarters of employment.

125% is the correct number to look at. Doing a K1 you will need to be ready for AOS in a short period of time. If you/fiance meet the requirements for the I-864 you will be set for the I-134.

Do some reading through the asset calculations for the i-864 using the value of your fiance's home to see if that will be sufficient along with his disability income.

The income requirement is black and white. Do the calculations. If his income and assets don't qualify then get a sponsor that does. No need to have it "ready and waiting."

I just wanted to add that he has to be able to show that he can support you...not that he can't, but he will need documentation to show the Consulate that he can, as per THEIR determination, not his. So, if he doesn't meet the requirement, no matter what doesn't sit well with him or not, he's going to need it.

Read the guides in terms of assets and what may be covered. I think assets, or liquid assets ( I don't know that you can use a house, in terms of this economy), and I belive they have to be 3 x's the $ amount they require, you could maybe go this route.

Having a co-sponsor paperwork ready in case you DO need it, is important, especially if they won't grant the visa anyway. While it's appreciated that your SO wants to be able to do this himself, don't let his pride get in the way of your visa being approved!

When calculating his assets to supplement his income you need to look only at the amount his income falls short . For example if his income is 12,000 a year and the household size is 2, based off the 2009 guidelines of a household size of 2 is 14,570 X 1.25 (125%) = 18212.50. so you subtract 12000 from the 18212.50 would leave 6,212.5 shortage in income. Now using assets to supplement you would take the 6,212.50 x 5 (since it is K-1) it is based on 5 yrs support so the value of the house or other assets would have to be worth 31,062.50. to qualify for the 125% support requirement. Hope this clears things up for you.

Can't you only use assets if they're readily convertible into cash?

That was my understanding. That's why I said liquid. I'm not very conversant with money matters, so perhaps I used the wrong word. If so, I'm sorry OP. I think it's things like bonds, money in the bank etc.

Thanks so much for these great suggestions!! I will be seeing him soon, and I'll be showing him this, and we can research out what we need to do!! If this visa was denied.....well...I just won't think about that yet...

I do own my home too!! With no mortgage. And of course I'll be selling it. I did read that although my income doesn't count, assets might have a chance...so hopefully, there is that. All we need to do is sail through the next few years to the removing of conditions part and by then, I hope to be working and that will help.

If anyone thinks of some other avenue to check out, I'd really appreciate it!! :star:

Hi Joyce, he either meets the income requirements or he doesn't. If he doesn't you'll need a co-sponsor. There's no shame in going that route; it's something lots of people need to do, and is just one of those things.

I would certainly have all the co-sponsor info and supporting evidence with you at your interview, so you can present it there and then if requested.
