i am separated i lived my own apartment with my daughter. the reason i left in the house because my husband he used his hand on me theirs police report says abuse fv. he filed devorce against me, He keep saying me lets work out the marrieds for the sake of the baby. then i'll seen him with other woman. i have pending devorce now? he is U.S army

my question

1. what are the requirements if ever i filed for abuse? and what are the waiver they need?

2. The police report says abuse fv are considered battered in my case?

3. Do i qualify for this case battered and what are the requirements for this?

4. Does he need to signature the 1-751 form in order i can submit to USCIS.

5. if ever he sign the form what the requirements are they same as on the form

please give answer and i need guide how i sign this form thanks

Since you are not divorced yet, file under Part 2 e or g of form I-751, which is in the most of the times hard to prove.

Later, if you get divorce and your case still pending with USCIS then file again under Part 2 d of form I-751 stating that you are withdrawn your earlier case. Under this situation, you do not need his signature on I-751 form.

At this moment, better get a help of experienced immigration attorney on this matter.

When you file for the waiver, it's still the same I-751 form but on part 2, you have to check the e as basis of your petition. You have to provide them all docs pertaining to your abuse waiver. But before you can apply for the waiver (form I-751), you must file it with your divorce decree & other evidences. You can't file until you have the final decree. He does not need to sign if you're filing on your own.. I believe he only sign if you're filing jointly but on your case, his signature is not needed. So sorry to read about the abuse. wait for your divorce decree and then file for removal of condition. abuse is very hard to prove.
