USC father just find out he has a son in Gaugamela

hello evryone,,

one of my freind asked me yesterday how to bring her half brother who is 12 years old to US,she said the boy lives in Gaugamela(some spanish country) never been in US .the child's uncle who used to take care of him got killed ,the child moved with his mom,mom in too some prositute.my freinds who is 20 and her father are very upset about the boy and want to bring him over here in US and take care of him ,,the child does not have his fathers name mentioned anywhere in his birth certeficate cuz the father and mother were never married and it was just short time of relation and were saprated before the child was even born..so what is thier option if there is any ,to bring the child here in US

The child is almost certainly a Guatemalan citizen. He may also be a US Citizen. Since he was born out of wedlock, the case would have to meet the requirements of INA 309

Sec. 309. [8 U.S.C. 1409]

(a) The provisions of paragraphs ©, (d), (e), and (g) of section 301, and of paragraph (2) of section 308, shall apply as of the date of birth to a person born out of wedlock if-

(1) a blood relationship between the person and the father is established by clear and convincing evidence,

(2) the father had the nationality of the United States at the time of the person's birth,

(3) the father (unless deceased) has agreed in writing to provide financial support for the person until the person reaches the age of 18 years, and

(4) while the person is under the age of 18 years-

(A) the person is legitimated under the law of the person's residence or domicile,

(B) the father acknowledges paternity of the person in writing under oath, or

© the paternity of the person is established by adjudication of a competent court.

If the case meets those requirements, the father could probably file for a consular report of birth abroad, and get a US passport for the US citizen child.

There's still the issue of how to get legal custody. That's one for the Guatemalan family law attorneys.
