Hej everyone,

First post. I'm an American who married a Swede. We sent in our i130 in July, and just got a RFE notification request for "additional evidence" a week ago and have not yet received the RFE via snail mail. I'm leaving to visit my husband and will not be around to check the mail for 2 weeks--which in total will be three weeks after notification of RFE. I've started to gather up documents based on what people have written on this site, but at this point its so much speculation about what they will want. I also know that people have had some difficulty with telling USCIS that the personbevis is indeed a marriage certificate. I worry about not getting all the documentation to them before my RFE window closes....any advice? Will calling them tell me anything? Has anyone gotten request for additional evidence from Sweden recently? My service center is Nebraska.

When I used a personbevis as "proof of name change document" I gave a written, signed statement about how it works in Sweden and the function of the "civic registration certificate". Along with this I provided information from the Swedish tax agency's website that stated the same. Here is a link with information for foreign agencies.

Hi everyone! I'm asking this on the behalf of my best friend, who's about to submit an I-129F application in January! :idea:

So, she and her fiancé met during her trip with me here to the United States (She's on VWP until January 10th). They've decided to do the K-1 route. However, he has 30+ criminal records (2 of which are for domestic violence, he took the blame for his ex-wife for the first one, not sure about the second one.) She has autism and a heart issue (neither of which she goes to a doctor for regularly).

What are their chances of getting approved? Is CR1 a better option? Could he possibly write an affidavit explaining the domestic violence charges and she could bring that with her to the interview? Should they have a lawyer backing them up this whole process? My friend is really worried and scared they'll be wasting months and time and end up with a huge denial and she can't come back to visit on her VWP. He can't come to her in Sweden because he has a 4 year old daughter.

They have another red flag, she's 21 and he's 32. 11 years apart.

Ok, just so I have a clear understanding here, she just met this guy what in the last couple months and they are already engaged? That's extremely fast and nowhere near enough time to really know a person at all, 2nd, he has a criminal background including domestic violence for which one he is trying to make an excuse for? 3rd, he says he cannot go to Sweden to what, visit? Live? because he has a 4yr. old? This does not sound good for your friend and for me sends up a lot of red flags. You cannot just excuse domestic violence and think oh, he wouldn't do that to me, because it will happen. Your friend really needs to take off the rose colored glasses and really look at the situation as if it was one of her friends making these choices because it won't end well at all the rate she is going.

1. Yes, they met in November, and YES it it fast. I'll agree to that. However, they've been talking since June ONLINE.

2. It isn't an excuse, so please refer from judging him on this. You don't know the backstory.

What are the other criminal records about? 30+ is quite a lot. It will definitely matter whether they are recent and how he is living his life now... I would recommend talking to an immigration lawyer yes. You can get some free consultation from some to begin with. I also think with that background that more time as a stable couple would help them a lot.

If he has 30+ criminal charges I can see she might get grilled at interview to see how much she knows since they haven't been together long. Forget about the Online since June that's really not what counts in the eye of the CO. Also with domestic violence they might have to do AWA as one mentioned. The age won't be a problem we have 18 years difference and was never asked though we had been together for 2 years at the interview.

What are the other charges? you might have to get in to them all or your friend deff. has too.

That he can't come because he has a 4-year old I don't understand. If the child can't leave the country then I'm sure either the e-wife has the child sometimes or he has family who can look after the child for some days. I'm just saying this because I could see they might have a hard case with that many criminal charges, not known each other for very long and just everything combined a visit from him OR more visits from her would be worth a lot.

The number of visits is a separate issue than proving that he isn't a threat to her, which is what he'll need to do and can be quite tricky.

I read a thread some time ago by an American guy who wanted to bring his fiancé here and apparently they were denied the K-1 at the interview because of his criminal records - those were about domestic violence. Seemed like the embassy wanted to "save" the girl from a marriage to that guy, no idea what was said to her exactly though. The application was sent back to USCIS.
