Gc&dl lying on the ESTA can come back and bite him big. He has abused the system and it's not looked lightly upon. Prepare for a ban, it wouldn't be unreasonable to think for longer than a year and don't expect for him to get a visitor visa any time soon. It won't matter if you guys let the K1 expire and start over next year. It might not show in the police certificate that he was convicted but the questions will still have to be answered truthfully. And the lies will still be there. I say bite the bullet, go to the interview and deal with it.

We have finally been issued a visa! We applied January 2015, and it has been a long road. I hope the rest of the Scandinavians waiting will be done soon ???

OP's on a k-1 though, which has a timelimit. It's not like the spousal visa, which can just be pushed forward for years. Unless it's changed, once OP has NOA2 on the k-1 petition, it's valid for four months. I guess in OP's case, they would just have to re-start the whole process in a year, but maybe that's what you meant?

He's still have to (unless he's going to lie on the medical too....) admit to drug use during his medical. They're then going to find out he lied on the ESTA which is misrepresentation.

No point telling you it's never a good idea to lie to the US federal government, I'm sure you're kicking yourselves for it today?!

So on his police cert that you are submitting with the supporting documents, it says that your fiance was arrested or has a drug conviction from four years ago? However, in the ESTA application, he answered no to question three "have you ever violated any law related to possessing, using or distributing illegal drugs"? That's not just misrepresentation, that's fraud, which carries a life long ban. Maybe the CO at the interview won't connect the dots but I would start looking into the possibility of a waiver, if there even is one, just in case. Better to be prepared and not need it then the other way around.

As he lied on the ESTA application he's going to have a hard time with both the drug use and lying about it. The embassy will take him lying very seriously. You should prepare yourself for a very challenging journey to be together. If he's denied the visa (which he will because of drug use) they won't allow him to visit on ESTA because he abused it by lying on the application. And they WILL fund out.

Thank you so much for all your input. Yeah it's already very challenging. We cannot afford a lawyer at all. I'm really lost atm. And this is all a headache to me. That was a huge mistake on our part lying about the visa waiver. So.. I dont know what to do..

I'm not familiar with the waivers but I do know that there are a lot of people who know a good deal about waivers, they've been here a long time and many people have dealt with admitting drug use etc. I recommend you go to the waiver section of this forum (link found below) and tell them your story, don't leave anything out or they won't be able to help you. Just wait and see what they say at the interview, you could be worrying over nothing. If it is a ban for misrep, then you know what you have to do.

I guess I can try the extreme hardship case if they don't allow him. Hopefully it's just a ban for misrep and they forgive the substance use on the police record. They won't find anything in the medical im pretty sure since he's not an abuser or anything like that. It was just a stupid mistake on his part. We will look into the waiver after the interview.

For the DS160, do you guys suggest we say yes on the drug abuse question then? And for the drug conviction, how do u suggest we explain the story?

Truth is always the best policy and he should say yes to the question about former drug use during his medical. Do not bring in any more lies.

USA will care about the drugs and will not "forgive" anything. For them it doesn't matter that Sweden has weak laws and that drug convictions etc goes away a few years after turning 18 and in certain cases.

A hardship waiver is really hard to get as you have to prove that this will be a hardship on you. I don't want to sound rude but you need to read up on this more because you clearly do not realize how serious this is. I would suggest looking into moving to Sweden.

A hardship waiver is really hard to get as you have to prove that this will be a hardship on you. I don't want to sound rude but you need to read up on this more because you clearly do not realize how serious this is. I would suggest looking into moving to Sweden.

There is a lot that goes into it, usually needing to be a I-130 case and some reason that the USC can't move abroad either because the country is unsafe or they have shared custody of children who live in the US or something like that.

The whole process is really lengthy too.

Seriously though, how is your Swedish? If there was one thing that would have made Scandinavia a successful experience for me, it would have been being conversational in Danish. You've got a leg up because speaking Swedish is easier than Danish.

Yeah, I graduate in a Chiropractic College this year and applying over there would mean having to learn the language which would take a long time because it would be alot of medical terms. It's gonna so much more complicated because swedish laws for chiropractic profession is different from the US ones. It's not too practical. I would have 200k worth of loans i would have to start paying off and if i further study there it would cost me more money. I will have to try for it. And if its for I130 i will go and marry him first. W/e will work. I'm pretty sure we will be able to get a waiver. Fingers crossed.

That's still not a hardship. Medical terms are the same as medical terms comes from latin. Swedes are also pretty fluent in English. Student loans can be paid off. You can always change profession if you can't work as a chiropractor in Sweden. Like I said, waiver is hard to get. Good luck.
