I was wondering if your fiancé said yes to the drug use when applying for visa waiver / esta.

The waiver I mentioned in regards to the ban is a completely different thing.

Guys, thanks for all the support and encouragement during our very long visa journey. It's really helped me stay sane throughout this long ordeal. Can't wait to hold that visa in my hand. Should be receiving it tomorrow or Friday, hopefully.

Haha I understand after all this wait it would be nice to just move! ... BUT just having the visa in hand makes it better and a bit more relaxing

No point telling you it's never a good idea to lie to the US federal government, I'm sure you're kicking yourselves for it today?!

So on his police cert that you are submitting with the supporting documents, it says that your fiance was arrested or has a drug conviction from four years ago? However, in the ESTA application, he answered no to question three "have you ever violated any law related to possessing, using or distributing illegal drugs"? That's not just misrepresentation, that's fraud, which carries a life long ban. Maybe the CO at the interview won't connect the dots but I would start looking into the possibility of a waiver, if there even is one, just in case. Better to be prepared and not need it then the other way around.

As he lied on the ESTA application he's going to have a hard time with both the drug use and lying about it. The embassy will take him lying very seriously. You should prepare yourself for a very challenging journey to be together. If he's denied the visa (which he will because of drug use) they won't allow him to visit on ESTA because he abused it by lying on the application. And they WILL fund out.

I'm betting they have access to the real computerized records and probably have already searched them for security purposes. Paperwork can be forged, so it is probably just a formality having to produce it.

GC-DL Sweden is pretty. Heck, I would have rather moved there or Norway than to America.

OP's on a k-1 though, which has a timelimit. It's not like the spousal visa, which can just be pushed forward for years. Unless it's changed, once OP has NOA2 on the k-1 petition, it's valid for four months. I guess in OP's case, they would just have to re-start the whole process in a year, but maybe that's what you meant?
