Hi! Good day !

Got married last day, and my husband will be going back to Iraq on Wednesday.

He wants to file AOS as soon as possible, and he wants me to be with him on August because his new assignement will be in Italy.

what paperworks do we need in support of AOS application for military spouse.

1.payment of $1010

2.cover letter

3.Form 1-485

4.copy of my passport

5.copy of K1 visa

6.NOa2 (Notice of action)

7.copy of 1-94

8. My birth certificate

9. marriage certificate

You need 2 more photos for the EAD and 2 more i think for the AP (travel document).

As a Military Spouse... I think you have the option of expedite your case... I dont really know how.. but you can call the USCIS line for military members and ask.

You need 2 more photos for the EAD and 2 more i think for the AP (travel document).

As a Military Spouse... I think you have the option of expedite your case... I dont really know how.. but you can call the USCIS line for military members and ask.

This is something that is listed on the USCIS website:

USCIS Expedite Criteria

All expedite requests are reviewed on a case-by-case basis, and are granted at the discretion of the Director. The criteria are as follows:

* Severe financial loss to company or individual

* Extreme emergent situation

* Humanitarian situation

* Nonprofit status of requesting organization in furtherance of the cultural and social interests of the United States

* Department of Defense of National Interest Situation (Note: Request must come from official United States Government entity and state that delay will be detrimental to our Government)

* USCIS error

* Compelling interest of USCIS

If your case is at a local office at the time you need to make your emergency request, please go to the local office in person to make your request. Please be sure to take all supporting documentation with you.

If your case is at one of our Service Centers or the National Benefits Center, please call customer service at 1-800-375-5283 to receive further instructions on where and how to send your request.

So they do mention something about defense personnel but I doubt you can expedite it when you are requesting it yourself (basically what they will say is "well she has to wait in the US", or so I think).

There is also another part about this:

Accelerated Processing

We understand the circumstances that bring about applications to USCIS. Many are urgent, which is reflected in our processing times.

We also have a premium processing program that lets you judge your own circumstances and decide if you want to pay for faster processing. We know that circumstances can change, so this program is available even after you file.

* At this time, this program is only available for the Form I-129.

o You may find additional information on our website under premium processing.

For all other kinds of cases, customers who file the same kind of application are usually in similar circumstances and often have similar needs to have their case processed quickly. We understand the effects our processing times can have on customers, and we are working hard to shorten processing time. It would not be appropriate for us to give preferential treatment to one customer over another, and disadvantage you or others by delaying one case to first process another that was filed later. Therefore, no matter how short or long the normal processing time, we normally process cases in order based on when they were received.

However, we recognize that truly extraordinary things can happen. Even when "Premium Processing" is not available, we will consider taking a case out of order if there is a life or death emergency, or some other exceptional emergent need, if our processing the case out of order will have a direct effect on the situation. To be fair to everyone, we are very restrictive in granting this kind of preferential treatment, in part because it means other customers have to wait longer. By definition, most kinds of applications and petitions rarely, if ever, merit this kind of preferential treatment. But if you believe such a situation exists when you file a case, or develops while your case is pending, call customer service for information about how to request accelerated processing, and about what documents and evidence you will have to submit to show that an exceptional emergency exists.

Examples of the criteria for making a request for expedited processing can be seen on the USCIS Expedite Criteria page, which you can link to under “Relevant Links.”

When reading this all, then I kind of doubt that you will get your application expedited.

I have a friend who got her case expited... but like i said before Im not very sure how it works... I think you have to request it after you get your NOA1.

hey evebody I have a question .My husband is deploying right now and he will be back just in june.we filled all the paperwork fot the AOS.and is ready to sent to Chicago ,but I was the one who did the front cover letter for all the documents that we are sending .Do you guys think that I'm able to sign for him ,since he is not here .I even have a power of attoney .Does anybody know anything?Should I sent a copy of his order saying that his deployng now ..or not ??Thanks ]

Thanks for the help.But Im talk about the cover letter, the one that we list everthing that we are sending with the package .The one who is opcional ,but most of peoples sent with the forms .So you can describle everthing inside of the package .Do you know if there is any problem in I sign for him ???

I didnt sign the cover letter... I just typed his name and dated it.. My husband is on deployment too.

Ok .I think Im going to do this ..I hear some peoples saying that the cover letter should have date and signature .But I really I want sent this tomorrow.So I guess Im going to sent without .The forms are the most important and he sign it .So I guess Im not gonna have a problem because of this cover letter .Thanks so much andgoo lucky!!!

A cover letter is not required but is is always a good idea, because it makes it immediately clear what is in your application package.

However, if you do use one, do not worry about your US Citizen husband not being able to sign it.

I am the (foreign national) applicant of the AOS too, and I put my name under the cover letter, and signed (and dated) it myself.

I hear some peoples saying that the cover letter should have date and signature.

My wife is the petitioner but I gathered all the documents and made the cover letter and I also signed it myself, there was no problem at all.

As a matter of fact, I have read multiple stories already from people who did certain explanations or asked questions on their cover letters but the USCIS never got back to them about that. I've even read that the cover letters are thrown away right away because they are no vital part of the package.
