I have some questions regarding this form 1864 since we got our NOA2..

I hope somoene can help us or give us any enlightenment about our questions.

My husband didn't meet the poverty guideline that's why we are going to use his dad as co sponsor. My husband is living with his parents at this time....

1. Part II of 1864 form: Should we put the address of the petitioner or the beneficiary's address?

2. Part 5. Sponsor's household size. What box should we check since the petitioner has 2 kids ( not married with the mother but he supports them)

3. Part 6 Number 24b Should we put the Name, relationship and current income of the co sponsor

4. Part 6 Number 24c Is this the total amount of the Petitioner and the Co Sponsor Total Household Income?

5. Part 6 Number 24d do we need to check the box since we have co sponsor?

6. Part 6 Number 24e Do we still need to check that box and put the name of the beneficiary?

Are all the documents should be original? What about the W7 and IRS forms, pay stabs.. Do we need to submit the original or just a photo copy?

I hope you can really help us about these questions..

2. Assuming the beneficiary is the wife of the petitioner, and she doesn't have any children:

a - 1, b - 1, d - 2 (If he claims his two children as dependents on his tax return. Otherwise, "d" should be blank.)

g - 1 (For the co-sponsor, if s/he is a household member of the petitioner.)

3. Yes, but only if the co-sponsor is a member of the petitioner's household.

4. Yes, but only if the co-sponsor is a member of the petitioner's household.

5. Yes, but only if the co-sponsor is a member of the petitioner's household.

6. No, unless you included the immigrant's (beneficiary's) current income on this form. (Which you'd include in 24b, too.)

The signatures should be originals - photocopied signatures may get RFE's. However, supporting documentation like W7, IRS stuff, etc need only be photocopies. The NVC doesn't require originals for the supporting documents.

Make sure you have the co-sponsor, if they are a member of the petitioner's household, fill out and sign form I-864A. Additionally, the petitioner will have to sign I-864A on Part 2, number 13.

Well it says[ Part 2. Information on the principal immigrant. ] that means that you need to put the beneficiary's information in there...

PART 5 goes this way:

Put 1 in 21.a [ in case you're the only one he's sponsoring, and if you don't have any kids who are immigrating to the US with you ]

Put 0 in 21.c

Put 2 in 21.d

Put 0 in 21.e

Put 0 in 21.f

Put 1 in 21.g

Put 5 in 21.h

PART 6: 24.b Put Your father-in-law's NAME, RELATIONSHIP [father] and his Current income.

for 24.c YES, this the total amount of the Petitioner and the Co Sponsor Total Household Income.

for 24.d YES, Check that box

24.e NO, Do not check that box.

Just photo copies will do... Form I-864 and I-864A, should be ORIGINALS, SIGNED and DATED... no need for notarization

Uhm, we are kinda confused... We got 4 answers from this same questions.. The other answers is in my inbox which is different from your answers. Most of your answer together with Maxonline are most likely the same...

My questions is

You and Maxonline and the other answers are all the same but the other guy told me to PUT NO since he said that the co sponsor will be filling up a 1864A FORM...

WHAT'S THE REAL ANSWER? WE NEED SO MUCH HELP FROM THIS.... :crying:

Ok Assuming the husband is filling out the I864 and the co-sponsor filling out the I864A (since they live in the same household)

part 5 -

Put 1 in 21.a [ in case you're the only one he's sponsoring, and if you don't have any kids who are immigrating to the US with you ]

21.b-1

Put 0 in 21.c

Put 2 in 21.d

Put 0 in 21.e

Put 0 in 21.f

Put 1 in 21.g

Put 5 in 21.h

on part 6 24B should be the co-sponsors relationship and income

on part 6 24c is the TOTAL (lines 24 a&b) so both from co sponsor and sponsor

on part 6 24d check that box because your cosponsor will be filling out the I864A

on part 6 24e do not check this box (would only be checked if you lived in the same household and you were using your money/assets as well)

IRS transcripts are usually easier to obtain and read than photocopies of everything, but either one is accepted.

Otherwise i agree with everything MaxOnline has said :thumbs:

To add up an inquiry..

If the petitioner has totally no income and will just be relying to the co-sponsor, so the petitioner will only be needing to fill out the I-864? and other components of the AOS (E.g I-864A, W2's, IRS, Employment Cert. Pay stubs. etc. )will be submitted by the Co-sponsor?

What other docs does the petitioner has to fill out except I-864?

06-11-19- NOA1

02-19-20- "Initial Review, Transferred to another Visa Center"

03-11-20- APPROVED!!!

Even if the petitioner makes ZERO dollars they still need to show tax returns, even if those returns show they made ZERO dollars, OR the petitioner can write a letter explaining (and add supporting documents as to why) they weren't required to file taxes for the past few years, in this case the petitioners income was so low they were not required by IRS law to file. There is a page in the instructions for the tax form 1040 which shows the filing requirements in a chart, be sure to add this to the letter ;)

I see. this gives me a lil clearer view on what we should do. Thank you.

Another question, say my hubby received an inheritance from his dad which is above the poverty guidelines,

what does my husband needs to do? does he need to state that in his letter? or what?....
