VSC did not send our case to NVC...

Hello!

We were atlast happy on Dec 18, 2008, that our case got approved after 10 long months of waiting...and we were so enthusiastically prepared for the NVC procedure! But VSC instead of posting the papers to NVC sent them to some National Recording Center (NRC) - by mistake as they say...for 2+ months after approval we were not able to get any response for NVC (obviously) and we were just so confused as to what might have happened...My husband wrote atlast to some congresswoman there in US and she helped us out with this thing by finding out that our case never reached NVC, instead VSC sent it to some NRC!!! Now how can they do this to us?!!! i mean this is no small mistake...our three months were wasted! It has been more than an year now since we filed and do not even have my case reached NVC :crying: it s soo very painful! Thank god we also had I129...and that also has taken an year now...i think i would get a date for my K3 interview in somewhere around the end of may...

so what should we do? are there any chances of our case I130 getting completed before my K3 interview in end of may and if yes how?!! are there any chance of converting the K3 interview into an Ir1/CR1 interview?!!

Usually the CR process can be completed in less than 3 weeks if you overnight everything and pay everything online providing there is no RFE. Then they will make u an appointment once is completed.

You can convert the K3 interviews to CR1 interviews providing the CR case is completed and was sent to your consulate. You can ask the NVC to send your completed CR case to EMBASSY as soon as possible and explain them why. It usually takes about 2-3 days once ur case is completed to forward to the embasy. When you have your K3 interviews just tell them that the NVC sent your CR packet if they can convert that interview to your CR. They will look in their computer and see if your case is in the embassy and will pull ur CR case/file instead of your K3 case/file. I hope this helps....sorry to hear about the MISHAP>>>

I think first you need to know what is being done to your I-130 at this NRC...to know if there is anything you can do to get that process sped up. Did your congresswoman offer you any explanation on this? I'm sorry, but what is National Recording Center? Do you mean to say that your I-130 is undergoing some additional administrative processing(AP) before it can be released to NVC for the immigrant visa processing? If that is the case, I'm not sure that you can do anything about that, other than wait it out. Has your K-3 visa petition, the I129F been approved yet?

If there is nothing you can do, but allow for the processing to take as long as it needs to take, AND your K-3 has been approved and sent on to NVC and on to the consulate, just proceed with that process and interview for the K3. I know it is a more involved process because your wife must adjust status once she arrives, here, but at least she would be here and you can be together. :)

I just made a post about the national records center a few days ago. My I-130 ended up there too last September and it took my congressman until last week to locate it.

The bad news is that in order to get your I-130 "released" from the national records center, you must submit the form I-824 , along with copies of your I-130, I-797 and $340.00. If that isn't bad enough, I was told this takes 6 months to process before your I-130 can be sent to the NVC.

if you have filed for K3 with a I-129F, they sure could hold your approved I-130 file at the records center. the purpose of the K3 to begin with was to get you a faster interview date while holding your I-130 petition. it would then be released when you would file for adjustment of status. looks like that has happened in your case. recently, they have started to approve both I-130 and I-129 together. but traditionally, they would approve I-129 first and send it to the embassy/consulate to get you a quick interview date. if the I-130 would be approved in the mean time they would hold it until you apply for AOS. you just have been unlucky that you were picked by them to follow their originally designed procedures. sorry to hear about your situation though and i hope all works out for you soon. good luck :thumbs:

if you have filed for K3 with a I-129F, they sure could hold your approved I-130 file at the records center. the purpose of the K3 to begin with was to get you a faster interview date while holding your I-130 petition. it would then be released when you would file for adjustment of status. looks like that has happened in your case. recently, they have started to approve both I-130 and I-129 together. but traditionally, they would approve I-129 first and send it to the embassy/consulate to get you a quick interview date. if the I-130 would be approved in the mean time they would hold it until you apply for AOS. you just have been unlucky that you were picked by them to follow their originally designed procedures. sorry to hear about your situation though and i hope all works out for you soon. good luck :thumbs:

oh my god! this is soooo bad!! so it s like they will release my file there after i get there on K3 first and file for adjustment of status?!! right? this is bad!!! i am soo very exhausted of this long procedure...as a matter of fact, both our files I130 and I129 got approved on the same day...

You cannot convert K3 interview for CR1/IR1 interview, as both are two different petitions and paper works need to be file. Basically, after approval of both petitions people ignore one for another depending up on their choice.

CR1/IR1 petition handle by NVC while K3 petition handle by designated US Consulate abroad (after K3 approved by USCIS, inform NVC, NVC forwarded the case to Consulate). If you start CR1/IR1 process now, most likely you will get May interview.

thats what it looks like you are going to have to do. you will have to file an adjustment of status after your spouse gets to the US. but werent you already ready to do an adjustment of status when you filed the I-129F. you should have had this in your mind to begin with. so what is the surprise about now?? you filed for K3 and thats what you are getting.

That procedure only lasted a few months, if you listed a Consulate or Embassy on your I-130, and submitted a letter with the petition requesting that your I-130 be sent to the Consulate/Embassy, then it is the USCIS's error. Don't file the I-824, it takes 6 months for approval, and then the I-130 may never be sent. Ours took almost 13 months to be sent to the NVC and only after the Ombudsman helped. Contact the OMBUDSMAN's office @ Dept. of Homeland Security, they will help you get the error corrected. It probably will not catch up to your K-3. Mike & Yizhen

the NRC hold's the file for AOS, they also hold the envelope you bring to the POE, both are used for AOS.

If you show up for the K-3 interview, and they have they have the IR-1 visa on station, they must interview for IR-1. I'll look it up if you want, but it states something like this, "If an immigrant visa is available at the time of the non-immigrant visa interview. The interview must be given for the immigrant visa"

That said, if you show up for the K-3 interview, and the CR-1 has not made it to the embassy, then it will be a K-3 interview.

I have seen people go to both interviews in this case. They got approved for both.

(I'm going for the IR-1 and blowing off the K-3. Even if it takes an extra couple months, it's worth it to not have to deal with USCIS again)

Note:

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)
